The SAE Second Critique: Twelve Readings

Foundational SAE Text · The Critique on the Practical Side

The SAE Second Critique: Twelve Readings

New to SAE? Begin with SAE Foundations: How a Person Becomes an End. This critique follows The SAE First Critique: Twelve Readings, which is best read first.

The First Critique audited the side of cognition; the Second audits the side of practice. A law a person gives himself has no outside guarantor, commands no one else, and can be revised by its maker at any time — by what does its cannot-not bind him, how far, and how does it live alongside the cannot-nots of others? The words examined are SAE’s own, and the heaviest cuts fall on its earliest, most forceful sentences. The answer puts in three things: a postulate, an in-domain zero point, a choice. Concession is unavoidable; adoption can be refused; it rests on where one stands; between laws, overlap without unification.

These twelve essays are independent reader-facing rewrites organized around arguments, not summaries of the book’s six chapters. The book remains the complete and authoritative source: read the book ↗ · DOI ↗

Essay 01
By What Does a Law Bind Its Maker?

A law a person gives himself has no outside guarantor, commands no one else, and can be revised by its maker at any time. By what does its cannot-not bind him, how far, and how does it live alongside the cannot-nots of others? The critique turns first on SAE's own earliest, most forceful sentences.

Essay 02
Dismantling Three “Necessities”

“This is not a choice,” “to exit is to be degraded,” “everything follows from the sole axiom” — the practical side’s claims of necessity everywhere go under the knife. The cannot-not is lowered to one that hangs on a position and can be left matter by matter; the law is no theorem of Negativa; nine kinds of cannot-not are each returned to their place.

Essay 03
The Divide Is Not “Inner”: With Kant

To say Kant’s law is universal and SAE’s is inner is inexact: Kant himself held that ethical legislation cannot come from outside. The real divide lies at the step to universal law and at duties of right; on duties of virtue toward others the two half meet. Kant posits a fact of reason; this book posits none, and sets up no postulates of practical reason either.

Essay 04
He Can Say No: The Zero Point on the Practical Side

Every act aimed at another’s will — domination, coercion, deception, persuasion — concedes in the act that he can say no, and within such acts the concession cannot be denied with performative consistency. The slaveholder must guard against escape; no one guards against livestock rising up. Concession is unavoidable; adoption can be refused.

Essay 05
Cost Is Remainder

Doing something by one’s own law leaves cost on one’s own books, and cost is remainder — the part this cut did not take in. When a man breaks an appointment, the friend’s disappointment is a consequence; what his own books record is that the rule “a promise made is a promise kept” was not taken in. Cost follows the law, is never compared across persons, and is not a price.

Essay 06
Stating the Cost Is Not Coercion

Accepting a power, exercising one, pursuing or giving up a value, stopping or not stopping: each has its cost, and each a reason it is overlooked. With another’s cost I can read, act by my own law, and decline to add consequences; I cannot read his constitution, cannot read his level, and cannot turn my reading into his cost.

Essay 07
Displaying More Than It Holds: The Case File at Home

A law or a cannot-not that displays a credential of validity it never earned is a false claim. The cases come only from SAE’s own published texts: the unconditional, deduction, the lateral, counting levels by heads, the final verdict and the present station, the drive, the standard, costlessness, unsourced validity, convergence. What is judged is the false claim; no person is convicted.

Essay 08
The Ladder of Precautions

Someone who denies that others can say no is testified against by his own acts: fencing in, banning literacy, fugitive-slave laws and passes, guarding against uprising, luring to death. Each rung shows which response of the other his acts draw on; what he denies in words is what his acts deal with all along. The stamp of performative inconsistency falls on a position, never on a person.

Essay 09
Autonomy, Obsession, and Fickleness

Why illusion comes naturally: the antecedent goes unwritten, the deeply settled sounds like how things are, what works for me seems to work for all, and cost always comes later. Two practical antinomies: cannot be cancelled versus can be left; unceasing as autonomy, or as obsession. Autonomy’s three marks: able to stop yet unceasing; the channel open under interrogation; revising the law with the books kept.

Essay 10
A Register

Diagnosis needs a ledger to check against: what each cannot-not the framework has stated actually stands on. Each entry gives content, status, source of warrant, opponents and branches, plus dependencies and domicile; even definitions list alternatives and costs, and are marked as no evidence. Seven postulates, a handful of configurations, the inhabited branches, two laws of this branch. Registration proves nothing; it makes each claim stand where it has earned.

Essay 11
It Rests on Where One Stands

By what does a law a person gives himself bind him? Not by a fact, not by a force from outside, not by a fact of reason: it rests on where one stands. To adopt is to take up a position, and for one standing there certain things cannot be cancelled — not because they cannot be done, but because “I stand here” and “I cancel this” cannot sit together in one person. The binding runs as far as where he stands, without exception.

Essay 12
Overlap, Not Unity

With the exclusive validity of universal law withdrawn, what remains between laws is overlap: secured by definition, formal only, intermittent, made out rather than presupposed, never a premise for giving orders. This is not each to his own: one step is yielded on who is wrong, none on what may escape examination. Harm beyond the overlap falls to external constructs. Rule out, never rule in; state the cost, give no command.
