Not on the List

Again

Something happened on that river again. Not long after the last round of remediation, the mill switched to a new dye: cheaper, and the color true. The monitoring list had been drawn up several years before; it named a dozen or so substances to be sampled daily, and the new dye was not among them. The technician sampled by the list every day, and every item met the standard.

In the household’s ponds downstream, the fish began to die again, patch after patch. They wrote to the mill. The letter was passed to the environmental office — the very office in charge of the list. The reply was one sentence: this mill’s effluent meets the standard on every item. The household held no position at the mill; the anonymous complaint channel had been set up for employees, and they could not reach it. There was also a joint review panel — the union, personnel, and a representative of the residents downstream — but it reviewed only cases forwarded by the mill’s own offices, and since the letter had gone to the environmental office first, it never reached the panel.

That same year, management wrote in the annual report: after these years of remediation, this mill is now a responsible enterprise; the joint review panel has completed its task and can be disbanded. Someone at a meeting put it more bluntly: “If everything can be questioned, the mill can’t get any work done.”

Must an institution go on being questioned? By whom? On what grounds can questioning not stop? Once it has answered, is the account settled? If it says it has reformed, may it stop being asked? This essay writes the last ought, which is also what the first four look like in time, and it closes the series.

Three Conditions

The fifth ought: an institution keeps open the channel through which it is questioned and corrected, a channel not controlled by the party questioned; and it answers for what it has itself produced. How Is Institution Possible gives the three structural conditions such a channel must meet: “independent of what is chiseled; actually initiable by members; initiation not met with retaliation.” Each has its reason. If the node under review can seal off review of itself, whether questioning goes on depends entirely on its willingness. An entrance written on paper that no one can reach is no entrance at all. And if using the channel becomes grounds for punishment, the protection cancels itself the first time it is used.

That paper adds: “This proposition establishes conditions only; it establishes no office and no ought.” Going from conditions to an ought is this series’ own undertaking, at the framework address, since its oughts are addressed to every construct with institutional identity. And the subject of that sentence is “members.” This series extends “actually initiable” to everyone inside, including those with no registered position. The grounds are three: the series stands on the stance that persons are ends; the interior is drawn by entanglement, and the household is tangled with the mill, the mill’s acts land on them, and they cannot get away by leaving; and what the mill leaves unaccommodated in their case is on the mill’s books too. A channel open only to employees cannot reach them. That extension, too, is the series’ own undertaking.

What does independence mean? The letter went to the environmental office, and the environmental office was the party being asked. That is exactly what independence is there to prevent. The joint review panel has the same flaw: it reviews only what the offices send it, so its entrance is held by the offices under review. But independence does not mean standing outside the mill. “‘Independent’ here is functional, and does not require being physically outside the institution”; “what must be prevented is only that the object of review can seal off review of itself.” A panel inside the mill can be independent, so long as its entrance is not held by the office being questioned and that office cannot decide alone whether a matter is looked into or when the looking is done. Independence is stated relative to the party questioned. If the party questioned is the mill’s management, or the panel’s own rules, independence has to be checked again against the new party; having the union, personnel and a resident at the table does not certify it once for every level.

Answering. An institution must not only let people ask; it must be able to answer. Among what keeps the framework address from being hollowed out, How Is Institution Possible lists: “when challenged, the framework can give a public answer from its own side.” “This mill’s effluent meets the standard on every item” is an answer — to the dozen items on the list, not to what the household asked. To bear the burden of explanation for what one has produced is to answer the thing that was asked. And this ought does not vary with relational thickness. The mill arranges almost nothing for the household, but when they ask, the channel must reach them all the same, and the answer must land on the point all the same.

Every Division Leaves Something Out

“Remainder” here means what an institution does not manage to take in. Where it comes from first. The First Critique, on boundaries, says that the shortfall a demarcation leaves can be handled locally in three ways — bring back what strayed, put in the missing conditions, widen the field — but each treatment is itself a new demarcation and leaves its own shortfall, because “correcting, condition-fixing, field-changing are all still intakes, still deviating.” How Is Institution Possible carries this over to social order and says it is stronger there: the objects of knowledge do not resist, but the people a social order takes in can say no themselves, so “‘Every act of handling is itself another cut’ therefore acquires an additional source here — the negation of those who are classified.” It limits the carry-over to divisions made by rules, categories and belonging, and records the four forms the shortfall takes: “shortfall of intake, misplacement, dual belonging, and exclusion by judgment.”

The series takes it this far: every division an institution makes by rules, categories and belonging leaves its own unaccommodated residue. The generalization was already walked upstream, but it covers only that kind of division. Sorting people into employees and contractors, settling who may use which channel: these are divisions of this kind. The monitoring list needs one more word. What it divides is substances, not people; its shortfall is in the first place epistemic. It becomes residue the mill must answer for because it acts on people. That paper says the aim of such an order is to arrange stably its members’ standing, their belonging, and the ways they may be treated; and the list acts on people precisely in how they may be treated: harm outside the list cannot be entered against anyone’s name, and the household’s voice falls outside the criteria along with it.

The field can be redrawn, and redrawing settles nothing for good. Leaving people whom its acts reach outside the field of judgment is itself a shortfall, exclusion by judgment, and the First Critique says: “out-of-field is the field’s own debt, the field itself being an earlier construct with its own remainder”; change to a wider field, and the voice can be judged too. If the mill takes only its employees as the field, the household’s voice lands outside, and the criteria have nothing to say about it. Drawing the interior by entanglement moves the field to the entanglement. The moved field still has its own remainder; drawing by entanglement is not drawing once and for all. Whether these shortfalls amount to harm, violation, colonization or oppression is handed on: “whether they constitute harm, violation, colonization or oppression is judged by the corresponding normative series.” This series takes the institutional share.

Two kinds of registration must be kept apart, or both sides go wrong. One is unaccommodated residue: what is left over when an institution divides under its aims, objects and range. A monitoring list cannot name every substance in the world. That is not an error; it is the shortfall division itself carries, and it is registered without a charge. The other is a particular problem: what the institution’s configuration or handling actually brought about. The mill changed its dye without updating the list; the fish downstream died; the letter went to the office that keeps the list and came back with a sentence beside the point. That has to say where it came from, which condition went unmet, which ought it touches; whether it is harm, negligence or dereliction is checked against the criteria for each. Kept apart, a new registration need not be some problem never seen before; residue is not shrunk to “only what has been proved harmful”; and ordinary classifications do not carry a charge before anything happens.

And remainders come in two types by where they come from. Type A is what the rules have not covered, and it is raised by persons. The new dye was not on the list, the fish died, the household wrote: that is an A. “Counter-instances that in fact re-emerge must be handled case by case.” Type B is what the institution has itself produced, and the institution must explain it. Opening the anonymous channel to employees only was the mill’s own division, and it put contractors and the household outside the channel. Type B has some visible shapes: the three degenerations How Is Institution Possible names — closing off questioning, the text kept while its substance is hollowed out, covering ground that should not be covered — any one of which suffices for a finding, while missing all three does not show there was none; exit friction an institution makes on purpose, which that paper calls artificial exit costs; guarding structures renewed without review after their conditions changed; shortfalls bred by fitting demands, authority and answering together. The two types overlap: the dye was the mill’s own choice and the list did not follow it, so the same matter has a B side. The division of the burden of proof survives the overlap. And two sentences hold: no one having raised it does not mean there is no A; the institution not having explained it does not prove there is no B.

Why It Cannot Stop

Someone in the mill asked: the letter has been answered, the list will be updated, the matter is finished — why keep the channel open forever? Continuing has its root in B. An A is a place where the rules did not reach; it is found and raised one place at a time. A B is different: it arises with the institution’s dividing, and so long as the institution is still dividing, it is still leaving residue. As long as the mill still draws up lists, sorts categories, makes rosters, it is still making things it has to answer for. So what must continue is the condition — the channel and the burden of explanation. Not that new problems spring up every moment; not that one matter must be asked forever; still less that somebody must always be asking.

Independence has its reason here too. A B originates with the party questioned, so that party must account for its own handling. That does not make every self-check worthless: the environmental office can check itself, find the problem, and fix it. The reason for independence is not that self-checks cannot be trusted. It is that the node under review cannot hold sole power to decide whether a challenge exists and whether it is over. Self-checks may be done; they cannot take the place of being questioned from an independent position.

If the household’s letter had got no reply at all, the original A would still be there; it does not change its origin by being ignored. If the non-reply, in this matter, amounted to a shortfall in the mill’s handling, a second item is entered, a B formed by that handling, and both are on the books. Not every silence counts: a reply still pending, a matter forwarded to whoever has the authority, a pause under stated conditions, or a matter already handled that need not be handled twice are not among them.

Answering one matter does not settle division. Suppose the mill responds properly: it adds the new dye to the list, and rules that concentrations below a certain value count as “trace” and need not be reported. That matter can be answered and closed. But the response is a re-division. By the First Critique’s sentence, every treatment is itself a new demarcation with its own shortfall. The new list still cannot name every substance in the world, and the new “trace” line will put some things below it. That share is unaccommodated residue, registered the first way; whether it causes a problem to be put right is checked separately. So the condition of being questioned cannot be withdrawn — not because someone failed to answer, but because however well an institution answers, the answer is itself a new division.

“Continuing” has two senses, which How Is Institution Possible keeps apart: an account that is not cancelled by being forgotten, and how long a relation or a procedure actually lasts — not the same thing, and not backed by the same warrant. Both are here. Past residue is not struck off because no one asks about it anymore, and what happened does not un-happen when the record is erased: “closing off questioning does not itself constitute evidence that the earlier problem has been resolved.” And new divisions go on leaving new residue.

One shortcut must be refused. How Is Institution Possible, setting its three conditions, says plainly that it does not use a certain reason: “One reason is not used here: ‘an institution is a construct, constructs have remainders, hence every institution must contain a channel for chiseling itself.’” For “A premise that holds of all objects may be part of an argument, but it cannot by itself yield this institutional constraint.” This series does not take that road either. That there must be a channel rests on the stance and the three conditions; Type B explains only why the channel cannot stop. Having residue is one ground of this ought, not the whole of it.

Every Mill on the River

The household’s letter did not stay at the mill. They photographed the dead fish and took the pictures to the authority in charge of the river. The authority looked into it, and added the dye to the public standard in the effluent permit. From then on not only this mill but every mill on the river had to test for it.

In that story something that had never been registered became something that can be claimed in public. Rights Theory calls this the second type of cultivation, the one on the system’s side: “a piece of questioning spreads some not-yet-registered remainder into the public field, makes it a position that can be claimed publicly,” and it names institutional accountability among the forms of this type. What this type lifts is not any one person who was questioned; it is the public space of rights, which has gained one more place. So calling an institution to account can be cultivation on the system’s side. But this ought does not wait for every questioning to bear that fruit before it holds. Not every question lays something out in the public field; some only clear up one matter; some come to nothing. The channel stays open whether or not this particular time it has amounted to cultivation.

One more thing must be kept. Whether to ask is the people’s own affair. The household could write or not write; the workers could use the channel or not. This series writes no oughts for persons, so it does not say that those inside ought to question. It says only: if they want to ask, the construct must let them ask, and must answer.

Reformed, So No More Questions?

Back to the annual report: “now a responsible enterprise,” followed by the proposal to disband the panel and check no more. The series’ answer is that it cannot be done. How Is Institution Possible lays down, on false claims of exhaustiveness, that one act of maintenance buys no permanent exemption, and that “counter-instances that in fact re-emerge must be handled case by case.” It also gives the measure for diagnosing such a claim: “What it diagnoses is a mismatch between the grounds held and the range claimed.” A remediation finished for a definite object, within a definite range, under definite tests, can be said to be finished; that has grounds. To disband the panel and declare that nothing need be checked again claims a range larger than those grounds: it falsely claims a local completion as permanent exemption from questioning. The business of the new dye happened precisely after the mill was “fixed.”

So an institution may not close off the conditions of questioning and correction on the grounds that it claims to cultivate, that it has already reformed, or that its aims are right. Structure and ought must be told apart here. The joint review panel is a structure: it can be changed, or replaced with some other arrangement — what is held to is the ought, not the structure. But after any change, the three conditions must still be there: independent, reachable, free of reprisal. To scrap the panel without leaving a road that meets those three is to close the conditions of questioning.

What continues is being open to questioning and able to be corrected, not change for change’s sake. The mill need not rewrite its rules every year to prove it is still being asked; an arrangement that was questioned and held up can simply stay. A closed case does not get upgraded into permanent exemption either: with new evidence or a new problem, it can be asked about again. And the series makes no prophecy that someone will always be asking. How Is Institution Possible states what it gives no warrant for: “When a counter-instance will emerge, who will handle it, and how long the handling lasts — this paper gives no warrant.” What this series sets down is an ought — the construct must let questioning happen and must answer when it does — not a forecast that questioning will come, or that someone will catch it.

Survival Proves Nothing

Behind “if everything can be questioned, the mill can’t get any work done” stands a reason: the mill has to survive. A construct’s own survival is not that kind of reason. The first premise of How Is Institution Possible is exactly this: “Any institution, including the most elegant constitution, is a means, not an end.” A means’ survival can be a condition for getting things done; it cannot be a reason to close off questioning. The same holds for guarding structures: the temporary suspension of the veteran’s right to mentor does not renew itself because “it keeps order,” and the anonymous channel is not exempt from being questioned because “it has to stay alive.”

That does not mean survival weighs nothing. A complaint channel still in use, an ongoing arrangement of care — if they are what protects particular people, they still have to exist, and that is precisely a reason to keep them going. What is excluded is “the construct must live, so it is entitled not to answer, or to carry on any arrangement just as before.” Continuing and dismantling both go back to the people protected, the task, the authority, the cost, and the commitments already made.

The other side of this. Dismantling an arrangement also has to face the rights, commitments and dependencies people already have. If the mill scraps the training program, what of those halfway through? If it closes a channel, what of the complaints already in process? If the mill itself shuts, what of the workers’ wages, their accrued entitlements, the cleaning-up of that river? Survival does not by itself prove something should go on, and dismantling is not thereby free of reasons. Dismantling is also the mill’s act, and the way it dismantles may not cross a line: first cutting people off from the ways they used to keep themselves going, so that they can depend only on this supply, and then pulling out — “splitting the act in two does not change the reading.” That part belongs to the first ought, undiscounted; the other rights, commitments and dependencies are checked as above. Writing this side into the ought is the series’ own undertaking.

A Direction

The five oughts have been written. One word remains to be placed: direction. This series has one, called the Kingdom of Ends. Its place: it is a direction, not an ought, and not a state to be inspected and signed off.

It is not written as an ought, because once a direction is written as an ought, someone will use its name to do the work of means: hold down today’s questions “for the sake of that day,” skip today’s explanation because “we are on our way there.” The five oughts are all demands on the construct today, each of them checkable today; the direction does not go on that list. Nor is it written as a state. Rights Theory has a hinge sentence for how rights unfold in time: “The additive path gives direction, not a historical guarantee.” There the direction is necessary, its necessity coming from the additive path; here only the structure is borrowed, not the necessity. Having a direction is not having an endpoint that will surely be reached, still less a timetable. How Is Institution Possible sets no terminal station either, so turning toward this direction is the series’ own step.

What the direction means, the First Critique says in one sentence: “the kingdom is not presupposed; it is what ends actually make when they recognize and interrogate one another.” This series takes that layer. The same sentence goes on to ask whether mutual recognition and examination can grow into common legislation, and leaves that to the practical critique; this series does not answer it. The “ends” there it reads as persons who are ends; an institution is a means and not among them. The Kingdom of Ends is not something laid out in advance for institutions to build; it is made, when it is made, by people recognizing and questioning one another. Where it has not been made, an institution’s declaring it does not make it so.

Nor does something larger walk the road in people’s place. Moral Law, on the trend of the human path: “the trajectory is the statistical aggregation of individual operations, not a metaphysical force operating above them.” The construct has no first person. Those who walk toward that direction are always persons, one by one; what the construct can do is what the five oughts say. An institution that keeps doing them can keep facing that way. Facing it is not carrying anyone there, and not having arrived.

The main line can now be said once more. Toward its internal subjects, an institution holds to anti-colonization and strives for cultivation; it itself remains open to questioning. Holding to: the mill crosses no one’s line — the technician, the supervisor, the household downstream, not one left out — and it guards the lines between the people inside, without waiting for the apprentice to grow up or the veteran to stop, judging operations and not persons. Striving for: conditions for cultivation, by how far the mill actually organizes people’s lives, concerned with conditions and not outcomes; room for people to meet, no road sealed, no “we” manufactured. Open to questioning: the mill keeps producing problems of its own — a list, a category, a channel open to employees only — and it has to answer for them; a matter answered can be closed, and the answer is a new division; saying it has reformed buys it no exemption.

The river still runs past the mill’s west wall. The household downstream still farms fish on its bank. The people in the mill have changed several times over, the rules have gone through several editions, the list has grown by a few lines. Not one of the five oughts can make this mill a good person; it has no first person. What they can do is see to it that the people tangled together along this river go on being treated, in this mill, as ends: not crossed; guarded when someone crosses; given conditions to grow; able to run into one another; and when something goes wrong, with somewhere to ask and someone to answer.
