The Hand Is Being Reworked by What It Holds
Abstract
Kant, Arendt, Machiavelli and SAE each give a mechanism for one and the same thing: a means reworks the party using it. The four act at different places and at different times, and none of them contains the others — each has cases the other three do not cover.
What this volume does not claim: that their coverages are disjoint, or that SAE's is the narrowest. What is proved is mutual non-containment, not mutual exclusion; and the four have heterogeneous domains, so there is no common ruler on which to rank them by width.
What is to be kept is one specific blind spot: §12 binds disqualification to information asymmetry, so an arrangement conducted in the open, with the executor fully informed, whose position as a subject is nonetheless abolished, gets no verdict from that criterion.
Three can be taken up, each differently. And the four together compose four angles of check for a list SAE cannot make on its own — but the four questions have to be preceded by a gate on the ground, because they screen what a means does to its user and cannot screen what an arrangement does to a particular person.
1. Four Mechanisms, Side by Side
Putting them side by side is the main move of this volume. Separately each looks like common sense; together it shows that they do not govern the same thing.
Kant: vices get carried into the state of peace. The sixth preliminary article forbids assassins, poisoners, breach of capitulation, incitement to treason. He gives six reasons, and the least-quoted is the sixth: these infernal arts, once employed, do not long remain within the limits of war. Take the use of spies — here one merely takes advantage of another's dishonesty; but such vices, once encouraged, cannot in the nature of things be rooted out, and will be carried over into the state of peace, where their presence will utterly destroy the purpose of that state. Note why he names spies. He writes it himself: here one merely takes advantage of another's dishonesty — he knows this is the most harmless-looking of the family, and picks it for exactly that reason. If even this one spills over, the heavier ones need no arguing.
Arendt: violence destroys power, it never creates power. She defines power as the capacity to act in concert — power belongs to a group and exists only while the group holds together. Violence is instrumental: it needs an external purpose to justify it, and its efficacy grows with the improvement of the instrument, independently of the number who hold it. Hence her judgement: violence can destroy power, but it can never create it; a regime that rules by violence has thereby shown that it has lost power. The time is immediate — not use it long enough and it spoils, but consumed in the very moment of use, because resorting to violence is itself the sign that the capacity to act in concert no longer suffices.
Machiavelli: those who live by war must wish war to happen. In Book One of The Art of War, Fabrizio Colonna argues that a well-ordered republic never allowed any citizen or subject to practise war as a trade — and what he gives is a chain, not a sentence. The trade has no ordinary livelihood in peacetime, so those who depend on it must wish peace not to exist. That incentive produces plunder: robbery, fraud, violence and killing are structurally attached to the trade. A commander's standing and income depend on war, so he has an incentive to deceive his employer to prolong it. When peace comes and such men are dismissed, they readily turn to armed adventuring and live by pillage. Whence a constitutional trilemma: a prince keeping professional soldiers in peacetime must go on fighting, maintain them indefinitely, or face a body of armed men whose livelihood has vanished. And loyalty attaches to the commander, not to the commonwealth.
SAE: the crux of gui is the suppression of one's own side's subjecthood. §12 says deceit is disqualifying not because it deceives the enemy but because maintaining an information asymmetry requires using one's own executors as instruments. If the executor knew the whole picture, the asymmetry could not be held; so to use deceit you must first keep your own people in the dark. One registration goes with it: the four-grade scale used here — mou, covert stratagem, open stratagem, deceit — had part of its legitimacy resting on a finding since withdrawn, that Sunzi had already made a similar distinction. The withdrawal is in volume six. Re-arguing the scale is not the interface series' business; it belongs to §12 itself, and this volume uses it before that argument is complete.
| Where it acts | Time | What it depends on | |
|---|---|---|---|
| Kant | the climate of one's own community | after the war | the irreversibility of habit |
| Arendt | power itself | immediate | power = the capacity to act in concert |
| Machiavelli | an interest group inside the social structure | long-term | livelihood tied to war |
| SAE §12 | the executor's position as a subject on one's own side | during the war | an information asymmetry requires the executor not to know |
2. Non-Containment Is Not a Ranking by Width
The four do not contain one another: each has cases the other three do not cover, so none can replace the rest. This has to be put precisely — what is proved is non-containment, not disjointness. A technique may perfectly well depend on information asymmetry, build a professional carrier, spill over into peacetime, and displace concerted action all at once. The four are not a partition. They are four angles of check with overlapping regions and regions of their own.
And the ranking SAE's is the narrowest does not hold either: the four have heterogeneous domains — climate, power, interest group, executor's position — and there is no common ruler on which to rank them by width.
Each one's blind spot can be named. Kant's cannot check the immediate case. A means genuinely used once, genuinely forming no habit, gets no verdict — and only once is a judgement one can sincerely believe in war. Arendt's cannot check means that do not use violence. Deception, bribery, blockade, information manipulation fall outside her definition — and those are the most-used class today. Machiavelli's cannot check the case with no professional body. An army raised for the occasion and disbanded after produces no one who lives by war. SAE's cannot check means that need no information asymmetry. A cruelty conducted in the open, with the executor fully informed, gets no verdict from §12.
So the thing to keep is weaker and more exact: §12's criterion is bound to the single variable of information asymmetry, so there exists a class of arrangement it cannot reach — no asymmetry, and the position as a subject abolished all the same. That sentence needs no judgement about relative width at all.
3. That Child
There is a ready example, and this volume sets it out in full because the later sections use it repeatedly.
From Nitobe Inazō's Bushido (1899), the chapter on loyalty, the story of Sugawara no Michizane. Michizane is exiled; his enemies mean to root out his line, and find his young son hidden in the village school kept by a former retainer, Genzō. The order comes down: on a certain day, deliver this boy's head. What Genzō thinks of is a substitute — and just then a new pupil arrives, of the same age as his lord's son and of similar appearance, brought by a mother of noble bearing.
Nitobe inserts one line here: the mother and the boy himself were equally aware of the resemblance; in the privacy of their home, both had already laid themselves on the altar. On the day, the official who comes to verify the head is that boy's own father; he calmly checks the features one by one and pronounces the head genuine. That evening, crossing his own threshold, he says to his wife: Rejoice, our darling son has been of use to his lord.
There is no information asymmetry anywhere in it. The parents know, the child knows, the teacher knows, and the official verifying the head is the child's father. Everyone is informed — and the child's position is abolished all the same: his entire function in the arrangement is that his face resembles another child's.
So §12 needs a supplementary criterion that does not depend on information asymmetry — and the four questions below run in that direction. (The full treatment of this case is in volume eight; here it is only a test object.)
4. What SAE Lacks Is the Carrier Layer
SAE's §7 gives a judgement at the layer of ideas; Machiavelli gives a mechanism at the layer of the carrier, and SAE does not have the latter.
§7 says war can be promoted from means to end. That is a diagnosis at the layer of ideas: the warring party has come, in the course of things, to take a means for an end. Its subject is the warring party, and a warring party is a thing that holds ideas. What Machiavelli gives is not an idea: there exists a group that eats by war. That group needs no one to make a mistake in their ideas. It need only act on its own interest, and war acquires a standing impetus.
SAE really does not have this, and it is harder than a judgement at the layer of ideas, for two reasons. It can be observed from outside. How many people in a society have their livelihood tied to a state of war is countable — the size of the standing army, employment in the arms industry, regional economies dependent on military orders. A slide in ideas cannot be counted; a tie of livelihood can. And it does not vary with intent. A wholly sincere decision-maker with no expansionist ambition still faces Machiavelli's trilemma: the men he keeps — what becomes of them when peace comes. The dilemma does not dissolve because his heart is good.
One verified point makes the judgement harder still: all six of Machiavelli's reasons are about incentive structure and social position; not one is a reason of efficiency. This series had earlier supposed the restriction's force came from holding up against efficiency — that was wrong, and the correction makes the argument stronger. If the force came from holding up against efficiency, it would be the result of a trade-off and would vary with the efficiency parameters. Coming from a diagnosis at the carrier layer, it does not vary with them.
Two consequences follow from taking it up. §7 acquires a checkable indicator: the share of the population whose livelihood is tied to a state of war. And the list of non-transferable techniques gains a cell: a technique whose operation requires establishing a professional body that lives by it carries that structural consequence with it, whatever the user's intent.
5. Arendt: Nearest in Reason, Differing on Cannot-Not
Arendt's is the closest to SAE in its reason, and the difference is that she does not handle cannot-not.
She defines power as the capacity to act in concert, and that corresponds closely to the structure of cultivation: a community's strength comes from its members' capacity to act together, not from how much coercion it can apply. SAE's §11 says nearly the same thing — the more deeply cultivated subject probably prevails, because cultivation is exactly the source of that capacity.
Where it differs: her analysis stops at violence cannot create power. The sentence is true, and it does not answer what to do when the other side is in the act of destroying your capacity to act in concert. So this is not a piece taken over to fill a gap. It is confirmation that two paths arrived at the same place, and then SAE walked on a stretch further. Theorem One handles exactly that position.
6. The Dichotomy Keeps; the Derived Diagnosis Does Not Transfer
Arendt's conceptual distinction between violence and power can be kept. What cannot be moved directly onto the side of the suppressed is the empirical diagnosis derived from it — that the appearance of violence proves an absence of common power. The registration has to be exact: her dichotomy fails on the side of the suppressed is too strong. What needs adjusting is not the dichotomy but a missing step of mediation when the derived diagnosis is transferred.
Her dichotomy: violence is instrumental, needs an external purpose to justify it, grows in efficacy with the improvement of the instrument; power is the capacity to act in concert, belongs to a group, and exists only while the group holds together. The derived diagnosis: to resort to violence is to prove that the capacity to act in concert no longer suffices. That diagnosis is accurate in her own domain — her book handles the relation between a regime and its own people, and a regime that turns violence inward really does show that it cannot sustain itself by concerted action.
Move it to the side of the suppressed and a step is missing. A community whose carrier of cultivation is being destroyed takes up arms not because its capacity to act in concert is insufficient — precisely because that capacity is still there, and is being cleared away by an outside force. The mediation to be supplied is a distinction: violence that replaces concerted action, appearing where concerted action can no longer be sustained, as its substitute; and violence sustained by concerted action, which is itself one form of concerted action, whose organization, mobilization and continuance all depend on that capacity.
With that distinction the dichotomy is not only kept but sharpened: in the second case violence has not become power — power is still that capacity to act in concert, and violence is one form it takes. The dichotomy is unbroken. What SAE keeps is the place of the second case, and Theorem One guards it. And this is not pointing out an error of hers. She did not draw the distinction because that was not her problem: her domain contains no such class as the organized resistance of the suppressed.
7. Kant Pushed His to the Position of a Criterion
What Kant gives in 1795 and in 1797 are two cross-sections of one thing, and the 1797 one is already a criterion rather than a diagnosis.
1795, the sixth article's sixth reason: the corruption of deceit spills over into the state of peace and destroys the purpose of peace itself. That is a diagnosis — a description of something that will happen. 1797, Doctrine of Right §57: a state under attack may use any means of defence except those that would make its subjects unfit to be citizens, because then it would itself no longer qualify to exist as a person in the relations of states; and the list of prohibitions opens with using one's own subjects as spies. That is already a criterion: it lays down a prohibition and gives the anchor for judging it — the civic standing of one's own subjects.
Put together with §12, the complete shape is three segments, not two. During the war (§12): to hold an information asymmetry you must keep your own people in the dark. The criterion (§57): whether a means may be used turns on whether it makes your own subjects unfit to be citizens. After the war (1795, reason six): that way of doing things will not vanish at the armistice; it is already how this community does things.
The middle segment is what SAE lacks. SAE has the wartime diagnosis and a general judgement about cultivation, and it has never written the standing of one's own executors into an independent criterion on means. Kant did.
8. One Ground Conflict, Registered Only
Chapter five of The Prince handles cities that have lived under their own laws in freedom. He considers three courses — destroy it, go and live there, or let it keep its laws under a friendly oligarchy — and concludes: whoever becomes master of a city accustomed to freedom, and does not destroy it, may expect to be destroyed by it; for in rebellion it always has the name of liberty and its ancient privileges to fall back on, which neither time nor benefits will ever cause it to forget. He tried three roads and admits the other two are not secure.
The point of contact is clear: what destroy targets is exactly a community's capacity to reorganize itself, and that is what the bridge clause on means guards — the very thing the criterion of the last section protects. The registration is ground conflict, not internal failure and not one disagreement. By this series' discipline, what touches the ground must be criticized, and where the ground is touched one says so plainly rather than going around; writing it as a place of disagreement would misname it.
This volume registers and does not unfold it, and the reasons have to be written down. This volume's object is the user's side — the whole piece handles how a means reworks the hand that holds it, and all four mechanisms and all four questions point at the user himself. Chapter five's problem is on the other side: what it abolishes is the conquered party's capacity to reorganize, not anything of the conqueror's. That exceeds this volume's object. The unfolding is elsewhere — volume two handles it completely, including where the contact falls (he takes holding as a premise needing no argument) and the limit on it (this is not to say he is cruel). And it must not be called an internal failure here: within the problem Machiavelli set himself — how to hold a newly conquered free city — his answer is self-consistent. The trouble is in that problem's premise, and a conflict of premises is a ground conflict, not a logical failure.
9. A List No One Has Made
SAE has a list no one has ever drawn up: the list of non-transferable techniques — which military techniques carry structural consequences with them, such that using one means you are no longer a 15DD party.
The list can issue a verdict on one side only, and that has to be written down first. Anything that trips a screening item can be judged as carrying a structural consequence. Anything that passes them all can only be recorded as this round of screening found none of the listed structural consequences — which is not a general certificate that a 15DD party may adopt it. Writing which techniques a 15DD party may take would exceed the strength of the screening: a finite screen cannot issue a certificate; it can only record that nothing was found.
§12 gave the first cell — deceit — and by the correction above that criterion covers too little: it governs only means that depend on information asymmetry. The four mechanisms side by side give four angles of check, and together they compose the list's criterion; SAE alone cannot give it.
10. A Gate on the Ground, Before the Four Questions
Why the gate is necessary has to be said first. If the order runs all four questions passed → declare structurally neutral, then the substitution case above is let through — it passes all four and the child's position is abolished all the same. That is the shape of should have been criticized and was not: the screen for blowback on the user's side finishes, neutrality is declared, and a ground conflict was never within that screen's range at all.
The gate on the ground, before the four questions: does this arrangement abolish any particular person's independent position as an end, or use him merely as a replaceable means?
Five trigger questions go with it; any one of them hit means a candidate ground conflict is registered first, and only then may one explain why it is not one. Does it fold a particular person into the overall interest of a family, a state, an undertaking or a community? Does it abolish his independent position to refuse, to withdraw, to revise, to answer, or to reorganize himself? Is he used merely as a means — that is, does his own standing as an end fail to enter consideration in this arrangement? (Replaceability is an external indicator of this one, not its definition: an irreplaceable person can equally be used merely as a means.) Does an external purpose acquire authorisation to abolish his position as a subject? Is consent, willingness, honour, duty or community membership treated as an automatic exemption from the prohibition on merely as a means?
The division of labour between the two gates has to be written down: the gate on the ground asks what this arrangement did to a particular person; the four questions ask what this means did to the party using it. Their objects differ, so neither can replace the other — and taking the four questions for a complete criterion is exactly that mistake.
Run the substitution case through it. It passes all four questions — no information asymmetry, no professional body, no violence, no habit formed — and it trips the gate's first, third and fifth: the child is folded into the family's overall interest; his own standing as an end does not enter consideration, his entire function being that his face resembles another child's; and willing, of his own accord is treated as an exemption from the prohibition on merely as a means. Add the gate, and that case is stopped on the spot.
11. The Four Questions
Having passed the gate, the technique enters the four screens for blowback on the user's side.
The verdict has to match the strength of the screen, and no universal may be issued here. Fail any one: this technique carries a structural consequence — that side admits a verdict, and one hit establishes it. Pass them all: one may only say on the dimensions covered by the gate and the four questions, no structural consequence was found. One may not say it is structurally neutral. The reason is this section's own: the gate's five triggers and the four screens are both non-exhaustive — the five were generalized from three known failures to criticize, and they will not stop a new one of a different shape. Two non-exhaustive screens both passed cannot support an unqualified verdict.
| The question | Source |
|---|---|
| Does this technique require one's own executors to be uninformed? | SAE §12 |
| Does it require establishing a professional body that lives by it? | Machiavelli |
| Will its way of doing things still be this community's way of doing things after the armistice? | Kant |
| Is it replacing concerted action rather than growing out of it? | Arendt |
12. Three Examples
These examples are only for testing whether the criterion is usable. They are not complete assessments of any technique — that would take knowledge at the execution layer.
Wartime secrecy — the first question asks about depth. Secrecy to the point where the executor cannot judge what he is doing: fails. Secrecy that merely withholds times and places from the enemy: passes. This cell could not be judged before; with the four questions it can, because the first question breaks the vague word secrecy into a specific question about the executor.
Total mobilization — one may not judge the second question failed. Total mobilization does not automatically establish a professional body that lives by war: a general mobilization can be temporary civic participation, disbanded when the war ends, and that is precisely the citizen army Machiavelli recommends rather than the professional soldiery he opposes. Whether the second question is hit depends on whether that mobilization produced a standing body with nowhere to go afterwards — which must be checked case by case, and cannot be settled by the phrase total mobilization. And the fourth question cannot be settled by conscript or volunteer either: conscripted means replacing concerted action, volunteered means growing out of it does not hold — a voluntary private force can equally displace public power, and a conscription can equally issue from a legitimate common decision. The fourth question asks where this technique's efficacy comes from, not how the participants enlisted.
Cognitive warfare — the third question is triggered, and triggering is not a verdict. The capacity for information manipulation it builds still exists after the war, and the capacity exists proves only that the risk exists, not that the practice must continue. Kant's reason — that vices once encouraged cannot in the nature of things be rooted out — is his claim; this volume cites it as the question's source and does not use it to declare the technique must fail.
13. One Limit, and That Fifth Question
The four questions are not exhaustive. The substitution case — everyone informed, no information asymmetry, no professional body, no violence, and no habit formed — passes all four, and that child's position was abolished all the same. So the criterion's existing four questions cannot govern this class, and the gate on the ground was set for exactly that. The relation has to be written down: this gap was found first, and the gate was added afterwards. The section stands unedited because it is the evidence for why the gate is necessary; the gap itself now has a treatment.
But one may not go a step further and say that one needs the second formula itself to appear, not these four derived checks of it — that sentence is refuted by this volume's own candidate. The candidate is: change the criterion from is the executor informed to is the executor in a position to refuse. It stops that case: the child grew up under the leverage of shame — Nitobe himself records that people will laugh at you and aren't you ashamed were the last appeal used to correct a child at fault — he is not in a position to refuse.
And what the candidate is not must be written down at once, because it very easily impersonates the gate. Able to refuse is not a complete substitute for merely as a means. A man able to refuse and not refusing may still be used merely as a means in an arrangement — consent does not change his position in it. Willing cannot make a person a means and no longer an end: the second formula does not say a person may not be used as a means without consent, it says a person may not be used merely as a means. Consent changes one aspect of the matter; it does not change that person's position in that arrangement. So the candidate can only be a fifth derived check alongside the four, never a replacement for the gate. The gate asks whether this arrangement uses him merely as a means; the fifth question asks whether he has a position from which to refuse — the latter is a common indicator of the former, not its definition.
14. Insight Is Not Enough to Make a Man Stop
The insight that a means will rebound on its user is not enough to make the man who holds it stop.
The evidence is in one and the same book. In The Art of War Machiavelli gives the fullest version of this mechanism there is — six reasons, from livelihood to incentive to constitutional trilemma, written out layer by layer. And in chapter five of The Prince he argues for destroying a city accustomed to freedom. The two do not contradict, because they answer different questions: the first asks how a republic should arrange its internal affairs, the second how to hold a newly conquered city. He is self-consistent in both.
And that is the content of the proposition. Insight tells you what will happen; a criterion tells you what you may not do. Between them lies a stretch of road, and that stretch is walked on the ground, not on the depth of the insight. A man who sees a mechanism perfectly clearly can do, in another domain of problems, the very thing that mechanism forbids — so long as that domain has no criterion joining the two places.
This is a limit on the four-question criterion itself: it can tell a user whether a technique carries a structural consequence. It cannot make the user care about that consequence.
15. Left Unresolved in This Volume
§12's criterion is bound to the single variable of information asymmetry, and the substitution case is a counter-example — everyone informed, position abolished. Whether §12 needs a supplementary criterion independent of information asymmetry is undecided. The candidate — a fifth derived check, is the executor in a position to refuse — already has a concrete test object, and it stops that case. Its standing must be written down: it is a derived check, not a substitute for the gate on the ground. A man able to refuse and not refusing may still be used merely as a means, so the gate can under no circumstances be replaced by it.
What remains undecided is that able to refuse is harder to verify than informed. The ownership of that difficulty is settled elsewhere: whether this criterion can be broken into publicly arguable sub-propositions is a formal question about criteria and stays inside this series; whether it can be broken apart in wartime is executive judgement and lies outside it.
And SAE lacks the middle segment — the standing of one's own executors written into an independent criterion on means. Whether to supply it on Kant's model has not been discussed.
