When the Reviewers Are Removed

A chief justice was suspended, reinstated, then excluded again. The court kept its name while the terms of remaining a judge changed. His eventual return reopened a question that no restoration could settle by itself.

On 20 July 2007, Iftikhar Muhammad Chaudhry won a decision allowing him to return as Pakistan's Chief Justice. In March, President Pervez Musharraf had made him unable to perform his duties and referred allegations against him to the Supreme Judicial Council. The Supreme Court set the measures aside. An exclusion by executive power had been challenged in court, with a consequential result.[1]

End the account there and the conclusion almost writes itself: the judiciary defended its independence. Less than four months later, however, Chaudhry and other judges were excluded again. This time the change concerned not only a particular officeholder but the oath under which a judge could remain a judge.

A court's name can survive that alteration perfectly well. A chief justice remains, judges take office and cases are decided. The familiar appearance makes more precise questions necessary. Who can no longer sit? What must those who stay accept? Which questions have been placed outside their permitted reach?

These are not matters of professional dignity alone. A person challenging detention or an administrative decision depends on the reviewing seat too. If the authority being challenged can rearrange who occupies it, a claimant encounters a difficulty prior to the merits of the claim.

An order that did not stop an order

The crisis began on 9 March. Lawyers organized support and protest after Chaudhry was prevented from functioning. An August 2007 report by the Law Library of Congress already described that mobilization and the July reinstatement. It was written before the second exclusion in November.[1]

Keeping the report in its own time prevents two shortcuts. July's success did not become unreal because another attack followed. Neither did contemporary celebration establish that the route used successfully in July could never be closed again. We have to follow the events rather than lend them the certainty of an ending.

By the autumn, the Supreme Court was hearing challenges to Musharraf's eligibility for presidential election. On 5 October it permitted the election scheduled for the following day to proceed, but directed that the final notification of the returned candidate not issue before the petitions were decided. It had neither cancelled the election nor finally disqualified him. Formal completion awaited an outstanding legal question.[5]

On 3 November, Musharraf, acting as Chief of Army Staff, issued the emergency proclamation and Provisional Constitution Order. The Constitution was held in abeyance. Government was still to proceed as nearly as possible in accordance with it, but subject to the new order and presidential orders. The constitutional reference remained while its place in the hierarchy was altered.[2]

The provisions about courts were explicit. They barred challenges to the order, the emergency proclamation and the judicial oath order, and prohibited judicial orders against the President, Prime Minister or a designated authority. The arrangement whose validity might be questioned declared that it could not be questioned.[2]

Seven Supreme Court judges issued an interim restraint that day, directing civil and military authorities not to act under the measures and judges not to take a new oath pursuant to them. The 2009 judgment preserved and discussed that restraint. The order existed. It did not prevent the new oaths or the change in the court's composition.[5]

Neither saying that there was a court nor saying that there was none quite describes this position. Judges had acted to stop interference; those carrying it out did not stop. An order and the conditions for making it effective were separate things. Someone needing protection experienced the distance between them in more than a technical sense.

Proximity in time is not access to every private motive. What the record establishes is that eligibility litigation remained pending, final notification had been withheld and the subsequent measures excluded much of the existing judiciary. Those events and consequences deserve examination without presenting an inferred state of mind as something directly witnessed.

The price of remaining a judge

The Oath of Office (Judges) Order issued the same day made continuation personal. Existing superior-court judges were to cease holding office immediately, except those given the opportunity to take, and taking, the prescribed oath within the allowed time. This was not an equal invitation issued to everyone, followed by an entirely unconstrained choice.[3]

The prescribed commitment included compliance with the emergency proclamation and provisional order. Those taking it were prohibited from questioning their validity or permitting such a challenge. Continuing to occupy a reviewing seat was tied to accepting limits on review of the measures that determined who could occupy it.[3]

That differs from filling an ordinary vacancy. An appointment process determines who may enter an office under its rules. This arrangement also required existing judges to accept a new order shielding particular measures from challenge if they were to remain. The reach of review and the tenure of reviewers changed together.

The institutional problem does not require us to invent the same thoughts for everyone who took the oath. Who remained and who was excluded are ascertainable facts. How a particular judge decided a later case still requires examination of that decision. Dangerous conditions do not supply evidence of every individual's personal obedience.

For those outside the arrangement, the consequences went beyond losing a title. The International Commission of Jurists reported on 13 November that Supreme Court judges who had refused the oath were effectively under house arrest. People whose work involved protecting others could no longer move about in the ordinary way themselves.[4]

The same contemporary statement estimated that at least about three thousand lawyers had been arrested since 3 November. Some had been released, with reports of further arrests. The figure is a reported estimate, not a retrospectively verified register. Its significance lies also in the cost imposed on the act of defending access to review.[4]

The Commission reported locked courts and bar associations, and searches of lawyers' offices. A claimant needs more than a provision allowing a petition: someone must be able to prepare it, reach the court and argue it. Apparently supporting conditions can become the point at which the entire route fails.[4]

The bar associations were therefore not merely a professional backdrop. They connected people whose normal work was dispersed among separate clients and cases. That network helped make a judge's exclusion more than his private request for reinstatement. It also made the organizations themselves targets of restriction.

The court had not simply vanished from state life. Its authority was being contested and its positions redistributed. Saying that law had disappeared misses how names, offices and judgments continued to be used. Saying that courts continued normally misses the people and questions removed from their work.

Returning is not turning time back

The 2008 election did not immediately complete reinstatement. The Lahore High Court Bar Association's account follows continued protest, party participation and the 2009 long march. It is a participant institution's history: evidence of how an organizing network understood its role, not an impartial allocation of all the credit.[6]

Prime Minister Yousaf Raza Gilani announced restoration on 16 March 2009. The formal notification dated 17 March restored Chaudhry to his position and specified that he would assume duties on 22 March, after Abdul Hameed Dogar's retirement on the 21st. Announcement, notification and resumption of work were distinct dates.[5]

The route had changed between judicial reinstatement in July 2007, exclusion in November and the later government decision. Litigation, professional organization, public protest, parties and executive action connected. Giving the whole outcome to a single heroic figure would make the conditions of return disappear behind the person returning.

On 31 July, a fourteen-judge Supreme Court bench declared the November 2007 emergency measures unconstitutional, illegal and without legal effect. It held that judges excluded under them should be regarded in law as never having ceased to hold office. That was a later judicial determination, not a description of how executive officials had behaved during the exclusion.[5]

Never having lawfully lost an office and never having been physically prevented from working are different propositions. A court could invalidate the exclusion without making the intervening inability to work disappear. Neither waiting claimants nor detained lawyers automatically recovered lost days when the judgment declared the measures void from the beginning.

Repair faced a further difficulty. The reconstituted courts had meanwhile decided other people's cases. Were all those outcomes to be erased too? While rejecting appointments and emergency measures, the 2009 judgment protected decisions in other litigants' civil, criminal and other matters, together with specified ordinary administrative and financial acts. Correcting the source of authority did not simply mean undoing everything done in its name.[5]

Those litigants' lives were not props in a constitutional drama. They needed to know where their cases stood. Repairing an unlawful rearrangement of power still had to consider people who had not produced it but whose affairs had already passed through the altered institutions. Stopping the world and beginning again was not an available remedy.

Nor did restoration certify every future judgment of the restored judges. Protection against this form of exclusion did not remove their obligation to explain decisions or settle the proper limits of judicial authority. Defending a court against arbitrary reconstruction is not the same as believing a court incapable of error.

Beside South Korea, the question acquires another layer. How can a concession won through public pressure become a route available in ordinary life? In Pakistan, bringing existing reviewers back required prolonged collective action. Someone needing a timely answer could not necessarily afford to repeat that whole struggle first.

The window does not close the history of military, executive and judicial relations, or establish that every later remedy worked. It leaves a specific test of attention: not just the name above the door, but who may remain to hear a claim, who can help someone reach that door, and whether an answer can matter at the time it is needed.
