A Limited Crown, a Narrow Door

The Crown changed hands and Parliament named the abuses it would no longer accept. More decisions would require its consent. That did not give everyone an equal place among those whose consent counted.

The offer of a crown came with a recital of things a king ought not to have done. On 13 February 1689, William and Mary heard the Declaration of Rights read aloud as the throne was formally offered to them. James II's infringements were named: suspending laws without parliamentary consent, raising revenue beyond parliamentary grants, interfering with elections. The new reign began with a record of objections to the old one.[1][2]

It is tempting to turn the occasion into a constitutional contract: sign these conditions and receive the throne. Parliament's own historical account cautions against that description. The declaration accompanied the offer; its provisions acquired statutory force later, through the Bill of Rights, which received royal assent on 16 December. Declaration, accession and legislation were connected events, not one transaction.[2][3]

The familiar conclusion is that royal power was limited. A less comfortable question follows: who could participate in imposing those limits? Requiring the monarch to obtain Parliament's consent did not give every person an equal say in choosing Parliament.

Both parts matter. Some constraints became more explicit and parliamentary consent became harder to bypass in practice. Political membership nevertheless remained narrow and unequal. The exclusions do not make the constraints imaginary. The constraints do not make the exclusions disappear.

An army behind the document

The story did not begin with a ruler persuaded by a persuasive text. On 5 November 1688, William of Orange landed in England with an invading force. James lost support and departed. The assembly convened to settle the succession was initially a Convention, rather than a Parliament summoned in the usual way by a reigning monarch.[4]

Military intervention, a disputed succession, religious divisions and political negotiation shaped the possible settlement. A document could help determine what followed without having caused the whole change. Nor does later constitutional stability establish that William arrived intending to create modern parliamentary democracy.

The geographical boundary matters too. The traditional picture of a nearly bloodless revolution in England leaves out the violence in Ireland and Scotland, as Parliament's historical presentation acknowledges. This essay follows an English institutional settlement. It cannot turn that settlement into an account in which everyone elsewhere paid the same small price.[4]

The declaration defended liberties by presenting them as existing rights violated by James. Its authors did not claim to invent every protection afresh. That gave their demands a language of restoration. It does not establish that those protections had previously been reliable, or that asserting their antiquity made further enforcement unnecessary.[1][3]

Consider revenue. The Bill of Rights prohibited raising money for the Crown without a parliamentary grant, or beyond the duration and manner authorized. The monarch still required resources. Need alone, however, was not to stand in for permission. What could be collected depended on an agreement whose terms mattered.[3]

Suspending laws presented a related difficulty. Someone who required others to obey could not simply decide that an inconvenient law should stop applying. The objection concerned a way around consent, not merely the personal shortcomings of the previous occupant of the throne. Hoping for a kinder successor was not the only available response.

The coronation oath used on 11 April added another commitment: government according to statutes agreed in Parliament. An oath did not enforce itself, but it provided terms on which conduct could be questioned. A promise to govern well was attached to rules the monarch was not supposed to define alone.[2]

The Crown remained a governing institution, not the purely ceremonial office a reader might picture from a much later period. The change concerned routes particular decisions had to take. Revenue needed authorization; laws could not simply be suspended; some disagreement had a protected place. Governing continued, with constraints on proceeding entirely through the ruler's own will.

Consent has to come back

The statute protected speech, debate and proceedings in Parliament from challenge in courts or places outside it. For someone entitled to sit there, this was practical protection: an objection voiced inside was not supposed to become grounds for punishment elsewhere.[3]

That provision was not universal freedom of expression. Its location defined its reach. Reading that boundary accurately helps us see whose position changed, without assigning the same protection to every person speaking in any setting. A significant liberty could be limited in scope.

The Bill also called for frequent Parliaments so that grievances could be redressed and laws amended. One meeting followed by an indefinite absence would leave little opportunity to reconsider what had been approved. Consent needs another occasion on which it can be withheld, modified or attached to different terms.[3]

The Triennial Act of 1694 made recurring parliamentary participation more concrete, limiting a Parliament's maximum life to three years. This was not an annual general election, nor the first invention of parliamentary meetings. It was a further arrangement for keeping a future opportunity from depending entirely on the Crown's convenience.[6]

Recurrence also acquired force through something less idealistic than a declaration: William's wars needed money. The Crown had to return for resources, and parliamentary control of supply made continued sessions important. The institutional relationship developed through repeated demands and negotiations, rather than being delivered complete at one ceremony.[5]

The public-accounts arrangements introduced in 1690, together with appropriation of revenue to specified purposes, connected granting money to checking its use. An authorization did not have to end scrutiny. After a decision had been made, there could still be an account to give of what was done with it.[5]

A more effective revenue-raising state and a monarch more dependent on Parliament were not opposites. Increased capacity could coexist with a stronger requirement for consent. The useful inquiry is where that capacity passed, what records it left, and who could ask to examine them.

This changes the pace of the story. A declaration was read on one day; the practical relationship developed over years of sessions, spending and disputes. Remembering a founding date should not make us imagine that its participants completed the work of scrutiny for everyone who came after them.

Who was inside the word we?

The demand that parliamentary elections be free did not establish an adult franchise. Eligibility varied by place and property. Some borough votes attached to particular properties; residence did not supply everyone with the same entitlement. The institution gaining influence represented a much narrower political community than a reader accustomed to equal suffrage may suppose.[8]

An MP's ability to oppose the Crown and a resident's equal opportunity to choose that MP were different capacities. There could be consequential disagreement inside an institution whose entrance remained restricted. Taking the disagreement seriously does not require forgetting those outside. Taking the exclusions seriously does not require declaring everything inside meaningless.

Religion drew another boundary. The Toleration Act of 1689 allowed many Protestant dissenters to worship publicly under conditions including an oath of allegiance. That relief mattered to people facing religious penalties. It did not establish equal standing for every belief: Catholics were excluded, and dissenters retained other disabilities.[7]

The same settlement could relax restrictions for one group while maintaining another group's inferior position. The language of liberty did not mean that liberty arrived for everyone together. Greater security for some could be built alongside an enduring identification of others as a danger.

The Act of Settlement of 1701 arranged a further Protestant succession through the Hanoverian line and reaffirmed the exclusion of Catholics and people married to Catholics from the throne. Parliament's capacity to determine succession constrained a hereditary Crown. The choice it made also maintained a religious boundary.[9]

This is not an unrelated defect added to balance an achievement. Constraint and exclusion belonged to the same arrangement. Who had to be consulted, and whose religion could disqualify them, were both questions about how power would be exercised. Separating them too neatly obscures the settlement we are trying to understand.

For Catholics, the consequences were not confined to a throne few people could ever inherit. From the mid-1690s, annual land-tax legislation required Catholics to pay at double rates. A Crown less able to raise revenue unilaterally did not prevent parliamentary taxation from discriminating by religion. Consent to taxation still left open whose consent counted and who bore the charge.[7]

Parliament therefore cannot silently stand for every person, any more than legally authorized taxation can silently stand for equal treatment. Making one power depend on another's agreement is an important change. How the agreeing body is constituted remains another question, not an objection the first change has already answered.

Placed beside South Africa, the distinction becomes sharper. The constitutional certification process there asked whether a majority's proposed constitution met previously agreed principles. The English episode concerns a Crown increasingly dependent on Parliament. We should not install the later court's reviewing role in a room where it did not exist.

Nor does this history rehearse the outcome of Pakistan's judicial crisis. That essay asks how reviewers could return after being excluded. This one asks whom an increasingly consequential reviewing institution still left outside. The histories can enlarge one another's questions without becoming earlier and later stations on a shared inevitable route.

The declaration William and Mary heard did not remain merely a document in an archive. But between giving it force and making its liberties equally available lay no automatic road. We can remember a Crown required to seek more agreement, and, in the same account, the people not equally included among those able to give it.
