Let Fortune Make Her Own Case

Fortune takes the witness stand

In Book II, Lady Philosophy proposes an unusual exercise: she will argue in Fortune's own voice, and Boethius may judge whether the case is just. The ensuing speech is not a caricature offered for easy demolition. It is a complete forensic performance.

Fortune begins with jurisdiction. Why has this man summoned her daily before the court of complaint? What property genuinely belonging to him has she taken? He may choose any judge for the dispute over wealth and office. She then states a condition under which she will lose: if he can identify any external good that is truly the property of a mortal human being, she will concede that what he demands was his.

She gives her account of the facts. Boethius entered the world naked and empty-handed. Fortune received him, fed him from her resources, and surrounded him with splendor. The generosity that once indulged him has made withdrawal unbearable. Now she has taken back what was always on loan. Wealth and rank recognize their mistress: they arrive when she arrives and depart when she leaves. If they were truly his, how could he lose them?

She then claims a right to inconstancy. The sky may alternate brightness and darkness; the year may cover the earth with flowers and then strip it with wind and cold; the sea may be calm or violent. Why should human appetite alone bind Fortune to a stability contrary to her nature? Her wheel raises the low and lowers the high. Anyone may climb aboard, but no one may call the descent an injustice once the rules of the game require it.

Fortune even supplies precedent and concession: Croesus, conquered kings, the entire tragic record of kingdoms overturned. She finishes with gentler questions. Has Boethius not received more than his share? Has she abandoned him completely? Does mutability not leave room for hope as well as fear?

The speech has a forum, a judge, facts, analogies, precedents, a burden of proof, and a condition under which its author accepts defeat. Philosophy has not built a straw opponent.

A verdict entered before the reply

When Philosophy returns the floor to Boethius, however, she frames the situation in advance. If Fortune spoke this way, she says, he could offer no answer—although he is free to state any rational defense of his complaint.

He does answer, but he changes the issue. These words may be sweetened by rhetoric and music, he says, yet the sufferer's grief sinks deeper than ornament can reach. When the sound stops, sorrow remains. Philosophy concedes the point. Her remedies so far have been soothing applications, not the medicine capable of curing his condition.

What Boethius does not contest is the question of ownership. He never identifies an external good that is simply his.

Philosophy later takes up that question herself. External things, she argues, are alien by nature; Fortune never had the power to make them ours. This is not a direct refutation of Fortune. It radicalizes Fortune's strongest claim. Fortune said, “These things are mine and were lent to you.” Philosophy replies, in effect, “They do not truly belong to anyone—not even to you.”

Fortune therefore wins half her case, including its most demanding half: Boethius cannot demonstrate that wealth or office belongs to him as his own good. Her positive claim of title does not survive. Philosophy accepts the burden of proof Fortune established and carries it beyond Fortune's conclusion.

The opposing argument has done real work. It sets the threshold that the rest of Book II must meet. Yet the personified opponent never speaks again.

An opponent as a measure

The SAE First Critique also requires each commitment to name its strongest opponent. But an opponent has a different function there. The dissenter is not merely someone to defeat; the possibility of a coherent dissent helps determine the status of the original claim.

Consider SAE's commitment that every act of knowing introduces an ineradicable shortfall. A theorist of perfect cognition can deny this without immediately contradicting himself. He may never be able to verify perfect cognition from within his own act of verification, but his position is intelligible. His existence therefore prevents SAE's commitment from receiving the hardest possible status. The opponent does not lose a lawsuit. He places a condition on the claim he opposes.

That is why SAE registers branches rather than absorbing them. A rival position marks the entrance to another path. Whether a habitable theory can be built there must be established separately, by those who take that path. No philosophy may provide another with free foundations or free confirmation.

Lady Philosophy behaves differently. She takes Fortune's best argument, makes it more thorough, and occupies the ground from which Fortune spoke. The rival's evidential burden is preserved; her standing as an independent speaker is not.

The contrast can be put simply. One method completes the opponent's case on the opponent's behalf. The other records the opponent's address and leaves the construction of that position to its own inhabitants.

The cost of a strong adversary

The first method is powerful. An argument becomes stronger when it answers the best available alternative rather than a diminished version. Philosophy's account of external goods can stand only because Fortune has already made ownership difficult. The apparently digressive speech is load-bearing.

But the method carries a cost. Anyone who has argued seriously with another person knows the moment: “I agree with your point, and I can state it more consistently than you can.” The reply may be correct. It may also leave the other person with no place from which to continue. He was not shown to be wholly wrong; his ground was taken over.

Institutional life offers the opposite practice. A dissenting view may be entered into the minutes without being adopted. At the meeting, this can look like nothing: the decision goes forward, no one is vindicated, and the room empties. Six months later, when the failure occurs, the record preserves a path the majority did not take. Registration is weaker than immediate victory and more durable than erasure.

Lady Philosophy lets Fortune make an exceptionally strong case. That strength allows the philosophical argument to move beyond accusation toward a stricter account of possession. It is the greatest benefit of allowing the other side to speak.

Its price appears in the same scene. Fortune finishes her defense, and the book never gives her the floor again.

然后是这一整段里最要紧的一句。她自己写下了她败诉的条件:

只要你能指出这些东西里有哪一样是任何一个凡人自己的,我立刻甘心承认,你讨的那些本来就是你的。

她给了对方一个可以赢的办法。

往下是她那一面的事实:你从你母亲肚子里出来的时候,是我把你接过来的,赤条条的,一无所有。我拿我的家当喂你,把你惯大,用一切归我管的东西的丰盛和光彩把你围了起来。而正是这份娇惯,弄得你现在受不了我。

现在我高兴把手收回来了。

于是她分了一对词:你用的是别人的东西,你欠的是一份谢;你没有那份可以喊冤的权利,好像你丢的真是你的。

理由跟着来,说得很硬:那些丫头认得自己的主母。我来,她们跟着来;我走,她们跟着散。

再说,要真是你的,你怎么可能弄丢。

然后她讲权。难道单单我一个,不许行使我的权?天可以放出晴日,也可以把同一批日子藏进黑夜;一年可以给大地戴上花和果,也可以拿风雨和寒冷把它搅乱;海有权风平浪静,也有权掀起浪来。人那填不满的贪心,凭什么要把我们绑在一种跟我们的脾气不相干的恒常上。

到这儿她把自己的规矩整个说了出来:

这就是我们的本事,我们玩的就是这一场不停的游戏。我们转那个轮子,让它一圈一圈滚;我们乐意把最低的换到最高,把最高的换到最低。你愿意就爬上来。可有一条:等我这场戏的章程要你下来的时候,你不许说这是欺负你。

最后她举旧例:吕底亚王克洛伊索斯,前一阵还叫居鲁士害怕,转眼就被送上柴堆;保罗为他俘来的国王流过眼泪;一整个悲剧这个行当哭的是什么,不就是运气不分青红皂白地把好好的王国掀翻。

收尾三问,一问比一问软:你在那份好东西里取得是不是比该取的宽了些?我是不是并没有整个离开你?我这份变来变去,是不是正好给了你盼着更好的理由?

一段完。

这是一份什么东西,值得说准。它不是一个被找来挨打的对手。这是一份有场子,有法官,有己方败诉条件,有事实,有权利主张,有类比,有先例,也有让步的辩词。

而写它的是哲学女神。

下一章一开口,她把话筒交回给他,交得也很有讲究:

命运女神要是这样替她自己跟你说话,你必定拿不出什么来顶她;不过你要真有什么能凭理护住你那份怨诉的,你该拿出来。我们给你说话的地方。

她给了他发言的位置,同时把判词先写在了记录上。

而他拿出来的是什么呢。

他没有碰归属那一问。一个字也没碰。他说的是另一件事:你这些话漂亮是漂亮,抹了修辞和音乐的蜜,听着的时候是舒服;可倒霉的人对倒霉这件事,感觉是往深里长的。声音一停,那股沉在心里的悲还是压着。

她当场认了:确实如此。这些还不是治你的病的药,只是给你那还倔着不肯受治的痛敷的一点东西。

于是那一问就那么放着了。在他这一次回话里,命运女神提的归属之争一个字也没有被接住。

而更要紧的在后面。

第二卷第五章,哲学女神自己讲财富。她说的是:你为什么把外头的东西抱在怀里当自己的。事物的本性已经把它们弄成跟你不相干的了,运气永远没本事把它们变成你的。

这不是驳命运女神,这是顺着她再往前走了一步。命运女神说的是"这些归我,只是借你用"。哲学女神说的是"没有人能拥有它们,连你自己也不能"。

而她算总账的时候,用的是命运女神那个词。命运女神说"只要你能指出";她说:你算在自己那份好东西里的这些,明明白白指不出哪一样是你自己的好。

同一个词,同一份举证的担子,判词落在他身上。

不止一处。归属,占有,权,这几个词都是命运女神先在公堂上用的,往下第四章第五章第六章,哲学女神仍然顺着这一组词说。第六章她还把命运女神划的那条界原样留着:除了身子,以及比身子还低的那些东西,谁能对谁行使什么权。她还当场注明:我说的就是运气。

她甚至专门说明过一句:你别以为我在跟运气打一场不肯讲和的仗。

所以命运女神那一案,赢了一半,而且是最硬的那一半:他举不出哪一样外头的好东西真是他的。

另一半没有跟着赢。她那句"这些归我",哲学女神一句也没有认下;她接过那副举证的担子,往前推成了"这些谁也不真归"。

赢下来的不是命运女神的整块地盘,是她替归属之争立的那一道门槛。而这一道门槛,赢它的不是对手,是接手的人。

这件事这边也做,而且做成了一条必填的栏。

《SAE第一批判》登记它每一条承担的时候,一条要写四样:这一条主张什么;它是什么地位;它的担保从哪儿来;还有第四样,它的反对者是谁,岔口通向哪一支。

而"反对者"这一栏怎么算数,那本书写得很死。判一条主张够不够格上最硬那一档,看的是能不能有人一边反对它一边不用它,而且立得住。紧跟着一句限:所谓可理解,不是说你认同他,是说这样的反对者在人类历史中可能真实地存在过。

所以登记簿上那些反对者都是有名有姓的活人立场:把感知理解为纯粹领受而不含任何划界的主体;主张认识可以完备而偏差清得干净的完备论者;拿遗忘当清账的实用主义者;认识不留存而每一次全新的那一支;把认识读作不可分割的连续流的绵延一脉。

而最要紧的一条在这儿:那个反对者不是被驳倒的,他是拿来量的。

那本书里最重的一条承担是这么说的:认识对一样东西的每一次收纳都带着偏差,而那点偏差清不掉。这一条本书里还要再上场两次,这里先用它的反对者这一面。它为什么没能当上最硬的那一档,只当了一条承担?理由正是那个完备论者。他跟否认"有非"的人不一样:说"没有非"的人一开口就在做一次划界,当场自打嘴巴;而说"认识可以完备"的人不当场自打嘴巴。他只是永远没法从他自己的验证里头确证他成功了。

于是他被贴上的不是一纸驳回,是一个条件戳。

是他定了那一条的地位。

可接过来以后往哪儿走,两边走岔了。

哲学女神接过命运女神的案子,往前办得比她还彻底。命运女神说"这些归我",她说"谁也不归"。这一下她就把那块地占了:而文本从此没有再让命运女神开口。这一处的因果原文没有明说,是这一篇的读法:她最硬的那个举证位置已经被接走,而接走的人没有把位置还给她。

这边不许这么办。那本书写死过:各分支登记的资格平等,效力各按自己的账结算;跨支的效力仍须挣得;没有一门哲学能整体奠基另一门,路上也没有免费的整体互证。而对那些岔口,它明说:反对者指出的是分支的入口;那个分支住不住得人,得另外建,另外审。这边不替他建。

一个把对面的案子接过来办完,一个把对面的案子记在图上,办不办由他自己。

这一分,跟人争过事的都碰上过。

先说接过来那一种。

跟人争一件事,争到某一处你说:其实你讲的我完全同意,而且我比你讲得还彻底。

这一下他就没话了。

不是因为他错了,是因为你把他站的地方占了。争赢和把对方站的地方占了,是两件事。后一件更利落,也更让人不舒服,因为被占了地方的那个人,往后连提意见的位置都没有了。

再说记在图上那一种。

有的会上,反对意见是被驳回的;有的会上,反对意见是被记进纪要的。

记进纪要那一种,当时看着什么也没发生。没吵赢,也没吵输,散会的时候还是照原议办。

可半年以后事情真出了岔子,翻纪要的人找得着那一条。

回到那一段。

哲学女神把命运女神的话写得那么足,足到有人读到这儿会以为作者跑题了。而正因为写得足,后面那一整卷才立得住:她不必去驳一个稻草人,她可以直接站到那个最强的说法上,再往前走一步。

这是让对面开口能得着的最大一份好处。

而它的代价,也在同一句里。

命运女神说完那一段,全书再没有开过口。
