A small business can hold a very deep chokepoint

Imagine a water company with fourteen employees serving two villages. It builds the network, connects the schools free of charge, and makes daily life easier. Years later, citing a shrinking spring and equipment costs, it raises prices by 60 percent. In winter, it disconnects twenty-three households, including two with bedridden older residents. Its defense sounds straightforward: we are merely withdrawing our own supply.

Springhollow is fictional, as are its laws and the later Bluekiln examples. The purpose is to test a principle, not to report misconduct by real companies. SAE's principle starts with a chokepoint: a position that others cannot practically bypass when sustaining their lives or pursuing their development. Breadth asks how many must pass through it. Depth asks what is at stake when they cannot. A marketplace serving thousands of sellers has breadth; a tiny supplier controlling affordable drinking water has depth. Size alone measures neither responsibility nor wrongdoing.

A supposed alternative must be usable. In Springhollow, delivered water costs four times as much, permission for a new well has been pending for five months, and another village's wells have been filled in. Higher prices can attract entrants, but only if entry is possible soon enough. That winter, a price signal does not deliver water. Recognizing the chokepoint still does not establish that the price rise is unjustified: the company may face genuine costs, and its original contribution remains real.

Three different histories behind the same disconnection

SAE does not turn someone's need into an unlimited claim on any available supplier. Where there was no promise, no established claim-bearing supply arrangement, and no prior obstruction of alternatives, withdrawing one's own contribution is not, simply for that reason, an infringement. An organization must still explain its decisions, but dependence alone does not conscript its resources forever.

An established supply relationship is different. Lower Hollow has an agreement for pipes and unified supply. Upper Hollow has no equivalent agreement, but households have connected, paid for five years, and been billed under the company's continuing rules. A public extraction permit specifies supply to both villages. These arrangements treat residents as customers with claims, not occasional recipients of a gift. Withdrawal must therefore be assessed against responsibilities already undertaken or institutionally recognized.

A third history is more serious: first close someone's route to maintaining themselves, make them dependent, then withdraw. Lower Hollow had three functioning public wells. Under the agreement, the company acquired their sites and filled them in. Five years later it disconnects households. It is still holding shut a route that its own actions removed. Upper Hollow's wells dried up for an undetermined reason; the evidence does not attribute that to the company. Nor is the company automatically responsible for the state's delayed well permit. Being the only supplier is not identical to having actively monopolized supply.

These are overlapping questions, not exclusive boxes. Lower Hollow's supply commitment and the destruction of its wells each require an account. Ending an obstruction is not bestowing a new favor: it is stopping a continuing compression of someone else's possibilities. Reopening wells, creating an equally usable alternative, or securing replacement supply could address it. Water quality and implementation still need examination.

About 60 percent of Lower Hollow's assembly approved the agreement. That matters: pipes, two years of half-price water, and concern after one contaminated sample were genuine considerations. But consent does not erase the structure of what happened. Delegating authority while retaining revision and withdrawal is different from surrendering the means to withdraw. The record does not establish every exit provision or explain how the remaining residents voted. Neither wholesale invalidation of the agreement nor invented unanimous opposition follows.

Collect the debt without using life as collateral

Why protect water? SAE does not begin with an eternal list of commodities or a morally correct price. Water is a resource; life and bodily integrity are the foundational dimensions. Controlling a resource can violate those dimensions when it closes their actual means of maintenance. Concrete institutions can specify protected quantities and services, but the central question remains whose life a particular action obstructs.

Consider the paper's further hypothetical: a flood damages the treatment plant, repairs take three days, and the company charges triple for one month. That multiplier does not by itself prove exploitation; repair costs are unspecified. A price for the supplied thing remains an exchange condition. Using water to demand that a family sell land, abandon a petition, or vote a certain way instead substitutes the supplier's judgment for the family's own. Demanding payment of an acknowledged bill is not the same kind of demand. Whether residents accepted the additional 60 percent is a separate, unresolved question.

Yet a legitimate objective does not license every means. Within a relationship involving prior obstruction, promise, or recognized supply, the water necessary to sustain life must be removed from the machinery of debt collection. Whether a household cannot pay or refuses despite being able affects recovery of the debt; it does not make vital water available as leverage. The debt can remain payable while disconnection is ruled out as its enforcement tool.

Who pays, then? This objection correctly identifies a cost; it does not justify ignoring the boundary. The company is not a charity. Protection must bring the responsible public institution into the account, rather than quietly assigning an unlimited bill to the supplier.

Secure the supply, not the company's immortality

An irreplaceable provider at the foundation of life is doing more than managing an investment. It occupies a position through which a wider institution delivers part of its public guarantee. SAE identifies two sources of duty. Residents' recognized supply claims constrain the provider, supported by institutional incorporation, effective community recognition, and real enforcing power. Separately, the governing institution assigns or incorporates this supply function. In Springhollow, continuing billing, established use, and the permit's public purpose supply the relevant grounds. Residents do not earn rights by first submitting to corporate authority.

The division of responsibility matters. The supply position must deliver; the governing institution must create conditions that make delivery sustainable, including arrangements for those unable to pay, price scrutiny, and replacement when an operator leaves. The fictional utility law covers only suppliers serving more than five thousand households, leaving Springhollow's roughly one thousand outside the commission's price jurisdiction. That gap does not cancel the underlying responsibility. It also does not prove that no other remedy exists.

Duties attach to a position, not a lifetime of personal service. Investors and workers are not permanently bound to the plant. But an effective exit requires a transition process; announcing six months' notice and leaving pipes behind does not make them produce water without a spring or treatment facility. Public failure to organize succession must not become one person's indefinite obligation. Secure water, not the perpetual survival of this particular firm. The operator may change or fail, while past wrongful disconnections remain accountable.

A contract can close doors one after another

In fictional Bluekiln, a porcelain company employs about 70 percent of working-age labor. Its wages exceed the state industry average by 10 percent; it trains apprentices without tuition and has built a road. It also owns 40 percent of local housing, requires departure from its dormitories within thirty days of resignation, and pays 20 percent of wages in vouchers usable only at its shop and canteen. The shop charges about 15 percent more than Apple City. Outstanding advances require company permission to leave; resignation requires three months' notice; a two-year statewide non-compete threatens twelve months' wages in damages.

A potter with thirty-one years' experience wants to open a workshop with colleagues. With four months of advances outstanding, permission is denied. Relatives lend him repayment money, but the non-compete still stops him. Eventually Elmseed Long-Term Partners funds a settlement of six months' wages, and the company waives the restriction in writing. Only then does he leave.

Repayment, notice, and moving requirements are not automatically captivity. Nor should each be assumed harmless in isolation. Examine the same person's combined circumstances against the same boundary: can they refuse, withdraw from continuing attachment, or obtain meaningful review? Housing and vouchers belong in that inquiry, although the story does not establish their exact causal role in this potter's departure. A signature establishes acceptance, not a practically affordable exit. Higher wages and useful advances remain benefits; they neither offset obstruction nor become fictitious because obstruction exists.

A person's next direction is not the employer's property

On post-employment non-competes, SAE takes an affirmative position: they remove a person's choice of developmental direction and should in principle not be allowed. Succeeding as a potter depends on customers, finance, and other people's decisions; no one owes the departing worker commercial success. But permission to try that direction is a different matter. A prohibition backed by damages or an injunction deletes a direction before the attempt can begin. Narrow territory or duration reduces its reach, not its nature. Signature and compensation do not restore the removed choice.

The same standard applies to the former employee's own workshop. By year twenty-five it employs twenty-two people, including nine workers laid off by Bluekiln, but its apprentice contract prohibits opening a kiln in town for two years after qualification. Narrower, yet still a prohibition on direction. This judges a clause, not the moral character of someone who has occupied both sides of such a relationship.

Protecting confidential formulas or customer information is different from banning a life direction. So are narrowly justified restrictions on a particular exercise that would violate third parties' rights or obstruct public accountability. Those arrangements must identify whom they protect, why less restriction is insufficient, and what review remains available. Merely invoking protection cannot disguise a prohibition serving the employer's own interest in deterring competition. Training costs can be addressed through arrangements whose exit burdens are separately examined; training does not confer ownership of the trainee's future.

A genuinely additional, rejectable payment also differs. Suppose someone remains free to open a kiln but can receive extra money by choosing not to do so locally for two years. Three tests must hold together: refusal stops only that additional payment, rather than triggering prohibition or punishment; the money is not earned wages, deferred compensation, or previously paid funds reclaimed; and, considering dependence and other obligations, refusing does not mean being unable to survive. Formal optionality alone is insufficient.

The later Qiao Foundation program illustrates an unresolved boundary. After nine hundred layoffs, it offers three years of living support, about 90 percent of former wages, tied to a designated design park, three training tracks, and no work for other porcelain firms for three years. Departing stops payments without reclaiming past support. The plan does not say whether the work restriction survives departure. If it does, it is a prohibition; if not, the other payment tests still need checking. The missing answer must not be invented in either direction.

The right to choose a developmental direction belongs to people. A workshop's three-year agreement not to accept another investor is not automatically a human non-compete. Interorganizational exclusivity instead requires its own examination of chokepoints and checks.

Real exit does more than rescue today's dissatisfied worker. It keeps new relationships and alternatives possible. The funded potter genuinely creates a new workshop, but that success does not establish affordable departure for an ordinary worker. Two colleagues without the same funding stay; their full reasons are not recorded. SAE does not demand that everybody leave. It demands a social arrangement in which staying can remain a choice, and a fresh route need not depend on a benefactor paying to unlock the final door.
