Jimmy John's and a restriction that outlasted the job. A closing interlude for the first group of political economy readings.
Jimmy John's
Jimmy John's
A job can end before the paperwork has finished with you. You leave the workplace, but a restriction you signed still has two years to run.
For someone who makes sandwiches, moving to another shop to do familiar work sounds like an ordinary next step. A noncompete can put a question in front of that step: am I allowed to apply? It need not first produce a dramatic court case to deserve examination.
After marketplaces, hospitals, ratings and public investment, this first group of readings returns to a modest document in a hiring packet. The 2016 Jimmy John's dispute asks how a restriction is removed, not only from an employer's plans, but from the worker's understanding of what they can do next.
More than a circle around the old shop
Illinois's attorney general sued on 8 June 2016. The complaint alleged that the same noncompete was used for different store jobs, including sandwich makers and delivery drivers, without distinguishing their actual responsibilities. Signing was described as a condition of employment. These remain the state's allegations, not facts established through a full trial.[1]
The terms described in the complaint extended through employment and for two years afterwards. They covered businesses earning more than ten per cent of their revenue from specified kinds of sandwiches. An earlier version used a three-mile radius; a later one used two miles. Crucially, the radius was not confined to the employee's former workplace: it extended around any Jimmy John's shop nationwide.[1]
Reducing three miles to two might sound like a small, local restriction becoming smaller. Multiple possible centres change that picture. So does a revenue test that an applicant may be unable to check. The complaint itself questioned whether workers could obtain the prospective employer's revenue information or determine the clause's scope. A condition can be difficult to navigate as well as broad.[1]
None of this requires us to call sandwich making unskilled or valueless. Preparing food, managing orders and delivering reliably involve abilities worth having. The question is how much of an ordinary working ability a person can take elsewhere. Protecting a particular secret is different from claiming control over someone's future use of familiar skills.
Businesses can have legitimate interests in confidential information and in developing staff. Those interests need an account of their own, rather than being assumed from the fact that wages were once paid. Here the state alleged that store employees had minimal access to secret information and that separate confidentiality provisions already existed. Its challenge concerned the justification for this broad restriction, not the worth of every contribution made by an employer.[1]
The PetSmart essay makes a useful companion. There the question includes how to protect an actual training investment without acquiring the employee's next move. Here an earlier question is unavoidable: what precisely does the restriction protect? The fact that both arrangements were signed does not settle either inquiry. Nor should their shared effect on departure make us stop examining their differences.
Who needs to hear that it is over?
The company's response matters. Contemporary Associated Press reporting carried a spokesperson's statement that the attorney general had cited no example of the company attempting enforcement and identified no Illinois resident claiming resulting harm. The company said it was pleased to resolve the lawsuit. We should retain that position, not supply a fictional lost job, threat or wage loss to make the story more vivid.[3]
But an absence of cited enforcement examples is not proof that a clause could affect no decision. Someone who does not know it will not be enforced might avoid an opportunity. Someone else might obtain advice or disregard it. These are possibilities explaining why notice matters, not findings from an employee survey conducted for this essay. The distinction keeps an important mechanism from turning into an invented collective experience.
The uncertainty also comes before any possible lawsuit. A worker may need to decide whom to ask, how long to wait and whether to spend money checking a restriction before applying for a job they may not get. Those are costs worth considering. They do not establish that every person who signed experienced the same fear or suffered a measurable loss.
The complaint's account of discontinuance addressed precisely this gap. The state alleged that a proposed internal policy change had not been implemented through removal of old hiring materials, that some franchisees continued using the supplied forms, and that the intention not to enforce had not been communicated to relevant employees. Again, this is the plaintiff's account, not an independent audit of stores.[1]
Removing an electronic template at headquarters is not necessarily the same as replacing paperwork at a shop. Informing a manager is not necessarily informing someone who has already left. A correction has to travel beyond the place where the original rule was written.
On 7 December 2016 the attorney general announced a settlement. The official release listed notice to current and former employees that their noncompetes were unenforceable and that the company did not intend to enforce them. It also required notice to Illinois franchisees, asking them to rescind agreements based on the corporate model, and a process for removing noncompetes from hiring packets and stores.[2]
The release also specified $100,000 for the attorney general's office to use for education and outreach about the relevant legal standards. That was not an announcement of $100,000 in employee compensation, and it does not measure any worker's loss. Listed obligations are not proof, reviewed here, that every notice subsequently reached its destination.[2]
Still, the reason for including notice is understandable. For a former employee, an employer's uncommunicated intention is less useful than a clear statement they can receive, understand and act upon. A restriction needs to disappear from the person's account of their options, not just from a corporate document.
This brings the group back to its opening question. Does another shop, job or service already amount to another usable route? Sometimes information is missing. Sometimes the cost is too high. Sometimes there is nowhere practical to take a challenge. One kind of opening cannot automatically stand in for the others.
Providing work has value without conferring ownership over the worker's future. A business can take its contribution seriously, and an employee can take the work seriously, while both recognise that the relationship may end. The abilities acquired through doing a job are part of a person's continuing life, not merely an asset to be kept inside the original workplace.
This is a stopping point for the first group, not a single verdict on all its cases. The conditions differ; so do the evidence and remedies. What can travel from one case to another is a way of looking: what was contributed, what control followed, and how the person affected can understand, question or change the arrangement.
Where can a sandwich maker work next? The answer should be found not only in the next shop's vacancy notice, but also in a clear release from a restriction left over from the last one.
