Leaving Does Not Erase the Account

A country withdraws from the very petition procedure questioning it. It can leave. The people losing that route have not thereby received an answer. Both facts must stay in view.

Two men are serving sentences of twelve and nine years. Their trial was closed, their lawyers appointed by the court. They had remained behind when most members of a temporary council left with a withdrawing foreign army. DRP prosecuted them for collaboration. Years later, detention is still the most immediate fact of their lives.

DRP joins Three-Borders and accepts Article Fourteen, the individual-petition procedure. Relatives and a lawyer bring the case. The original convictions predate the provision’s operation for DRP, but the rejected appeal and continuing imprisonment follow it. The committee accepts the continuing effects under the agreed rule. It requests trial records and a prison visit.

DRP first answers that the trial followed national law. Then the foreign ministry, with presidential approval, withdraws from Article Fourteen and says it will no longer answer this petition. The procedure being questioned has an exit, and the very office receiving the questions has used it. What becomes of the people waiting outside?

A door can close without closing the question

Can the system stop the withdrawal? If it cannot, is petitioning only a courtesy extended while governments feel agreeable? ‘Withdrawal is a right’ does not settle those questions. It describes one side of the decision, not what the two men—and seven later petitioners—are losing.

Begin inside DRP. Its assembly voted to accept Article Fourteen, but did not vote to leave. Sixty-one legislators demand a vote; the presidium does not schedule one. Calling withdrawal a national decision cannot establish that the office currently being questioned should make it alone. Domestic scrutiny is itself at issue.

The system can scrutinize the decision too, record its timing and reasons, and ask why departure occurs during an inquiry. Scrutiny is not a final power of approval. An institution able to say ‘you may not leave because we refuse permission’ and enforce continued membership has acquired something beyond coordination among equals.

This does not require every departure to take effect immediately. Agreed notice periods, transition arrangements and unsettled obligations matter. But the party being left cannot keep extending the endpoint until every demand is met. An unsettled account may survive departure; it cannot become a lock with no usable release.

DRP’s declaration takes effect after twelve months. Petitions already filed continue; new ones after that date are inadmissible. This is one rule chosen for the invented case, not a recommendation that every actual institution adopt it. Its least attractive consequences belong in the account as much as its formal clarity.

In spring of Year Nineteen, seven new petitions are returned. Saying ‘external questioning continues’ must not make those seven refusals disappear. Other countries can ask and records can remain, but neither reproduces the procedure individuals could previously initiate. A lost entrance cannot be replaced by a larger-sounding principle.

There are other ways to lock members in. If the system seizes a member’s own reserves or imposes a decision over its domestic law to prevent departure, its name does not settle what power it has acquired. That superior power would need its own safeguards. ‘We merely cooperate’ would no longer answer the question.

Leaving is therefore not proof that there is nothing to answer. The decision to close a route remains open to challenge, without that challenge becoming a coercive means of preventing departure. Neither side may find this entirely satisfying. It at least keeps criticism distinct from confinement, and exit distinct from innocence.

Leaving the table does not erase what happened

What does withdrawal terminate? Primarily, the future relationship through which member rights and obligations are newly acquired or exercised—not the fact of everything previously done. Three time-based questions help: what happened during membership, what proceedings already began, and what someone seeks to initiate only after departure.

Conduct during membership stays on the record. The continuing imprisonment in DRP and Stonegorge’s unanswered camp petitions during its notice period occurred while the relevant commitments applied. Later departure cannot remove what was undertaken then. The entries need both the state’s address and the offices responsible for particular decisions.

Proceedings already initiated continue according to the agreement. In winter of Year Eighteen the committee asks DRP to reopen the trial publicly and allow a visit. DRP does not answer. The procedure can reach its conclusion while the requested response never comes. Saying ‘the petition was dealt with’ would risk suggesting that the prisoners’ situation improved.

By Year Twenty both remain imprisoned; one has moved to the prison hospital. This is not a minor disappointment for a footnote. It is the absence of enforcement made concrete. Questions reached their address, an opinion was issued, and the men did not come out. All of these facts can be true together.

Whether a new proceeding can begin after withdrawal about earlier conduct depends on the accepted agreement. Here the rule excludes all newly filed petitions after the effective date. The seven returned petitions therefore represent an actual loss. An agreement with different surviving jurisdiction would produce a different answer; wishes cannot fill the gap in this one.

Nor is an old account an endless moral tether. Shared resources, procedural obligations and transitional funding need identifiable arrangements, not an indefinite announcement that something remains owed. After Stonegorge leaves, agreed camp funding continues for the next half-year, and transfers continue until summer. Departure does not immediately cancel what the original agreement expressly preserves.

At the same time, Stonegorge can no longer initiate new common proceedings in the capacity of a member. It cannot retain every future benefit while calling all its accepted responsibilities finished. Which rights stop, which obligations survive and on what date require separate answers. The word withdrawal cannot do all that work alone.

Recall the hypothetical commander seeking asylum in Stonegorge. Withdrawal ends the compact’s future treaty-based constraint, but the responsibility not to return an arrival to killing, torture or detention without trial did not originate in membership. Leaving an agreement cannot also mean leaving behind responsibility for what one is presently doing to a particular person.

Departure is real; the account is real too. If any surviving responsibility means one has not truly left, exit becomes nominal. If leaving means no previous question remains, people affected by earlier decisions disappear with a procedural change. The task is to connect both facts to particular dates and matters, rather than choose the louder slogan.

Returning makes a new agreement

After Stonegorge’s withdrawal, troops leave Lamp Island, the navigation office closes and some displaced residents return. Its agreement with the Federation also provides inspection-free passage after notification, a twenty-five-year supply-wharf lease and a promise not to participate in any multilateral economic measures against the Federation. Relief arrives with consequential terms.

A new Stonegorge government later applies to return. Partners raise the two unanswered petitions, the wharf and the blanket promise about future measures. DRP’s representative argues that if leaving is a right, returning is one too. The sentence sounds symmetrical. The two decisions are not.

Leaving changes one’s own participation. Returning establishes obligations with others again. A new agreement needs their consent; one cannot announce renewed partnership unilaterally. Partners may propose conditions grounded in conduct and responsibility, but readmission cannot become a means of forcing changes to otherwise autonomous choices that infringe no one’s standing.

Stonegorge offers to answer the petitions and explain participation in each future measure separately. It cannot, it says, unilaterally alter its agreement with the Federation. The application is unresolved at the end of Year Twenty. We do not need a reunion to see why returning is more complicated than knocking once.

Two boundaries remain: readmission does not launder conduct during absence, and an ongoing colonial takeover cannot be carried back into membership. Conditions above those boundaries—what must precede what, and how outstanding matters are handled—require public explanation and judgment. No country’s name receives a permanent ban irrespective of present conduct.

Can a system expel a member instead? Here it can, under demanding conditions, but expulsion must also answer for itself. It ends a state’s membership, not the standing of its people. It does not erase accounts or transform an incursion begun by a member into something that was always wholly external to the system.

Expulsion may also cost people a route meant to protect them. Existing petitions continue as agreed; the system remains answerable for its own subsequent conduct. But people affected by the expelled state’s later acts may lose the member-petition route against that state. This is a real cost, not an inconvenience to omit from a satisfying story of removal.

Even dissolution of the entire system raises questions: who holds the records, where do pending proceedings go, and what happens to common resources? Making the best possible arrangements does not guarantee complete arrangements. The final meeting’s adjournment cannot establish that nobody has an unanswered question left.

Two men remain in prison, seven petitions have been returned and Stonegorge’s application waits. There is no ending that gathers every thread. Instead, when we encounter withdrawal, restored relations or expulsion, we can ask something precise: which relationship has ended, which matter remains unanswered, and which door can the person still waiting now approach?
