An Agreement Is Not the End of Questions

An unsettled nationality, an unpaid receipt, a family assigned to different destinations. Who can bring these questions to the decision-maker—and who gets to say the answer is enough?

The child has a birth certificate. In the box for nationality, it says undetermined. Another year passes. The word is still there.

In the source paper’s fictional setting, this is not a clerical omission. During a war, DRP—the Democratic Republic of Purposes—removed the nationality of people who went abroad and failed to return within six months. It would not register their children born abroad. Neighboring countries received the families but maintained their own conditions for citizenship. The parents crossed a border; their children were born between two sets of rules.

Later the three neighbors form a cooperation system. DRP accepts an undertaking not to use deprivation of nationality to push its people onto other states. The following year, its partners ask how many people lost nationality, how many children remain unregistered, and what DRP intends to do. DRP does not vote on opening the question about itself. It may present its account and have that account preserved. Having a voice is different from having the power to prevent anyone else from asking.

DRP answers that nationality is an internal affair and that its decree predates the compact. It also points to UCSE’s own rule: parents must have five years of lawful residence before these children can obtain citizenship there. How, it asks, is UCSE entitled to criticize? The public record includes that response. It also shows that DRP did not supply the requested numbers.

A question is not a new treaty

Requiring a respondent’s consent before every question would leave a permanent key in the respondent’s hand. The absence of a common superior, intended to prevent takeover, would become a general exemption from explanation. A new obligation and an inquiry into an old undertaking therefore cannot have identical conditions of entry.

The distinction does not give every questioner unlimited authority. Standing to ask and a specific obligation to answer are different. DRP has a duty within this procedure because it accepted the compact’s commitments and process. An outside state does not acquire the same treaty duties merely because the secretary-general sends it a letter. It may decline to answer. The question and the refusal can still remain public.

Nor may the questioner become the sole judge of whether an answer is sufficient. Otherwise questioning turns into command by another route: answer until I, and only I, say you have answered. Closure needs a position the questioner does not monopolize. Where such a position is unavailable, the unresolved part must be recorded as unresolved. An institution need not invent agreement to finish its paperwork.

Recusal is not self-validating, either. The secretary-general holds DRP nationality and steps aside. The deputy taking over holds the nationality of NUT, which initiated the inquiry. DRP objects. The secretariat applies the rule then in force and allows the deputy to act; the objection stays in the record. Following a rule does not make the rule incapable of further criticism.

Calling nationality an internal affair does not remove the question. Asking a government to explain a decision is not taking over its government. Here the decree also has consequences beyond the border: people without nationality live in neighboring countries, and their children’s certificates are issued there. The effects were never wholly internal to begin with.

DRP’s counter-question about UCSE deserves attention, not dismissal as an inconvenient distraction. If UCSE’s residence rule excludes the same children, it too needs an answer. But the second question does not settle the first. Two countries can simultaneously owe explanations to the same child.

After publication of the record, UCSE removes the five-year residence requirement. Eventually 389 children born at its reception center obtain UCSE nationality. DRP introduces a registration route requiring a parent to attend a consulate and regularize wartime departure paperwork. By the recorded deadline, 37 children have been registered through it. Their parents’ nationality is not restored.

These changes follow the record. The case does not establish that the inquiry caused them. They are decisions made by national offices through national procedures. We can preserve the sequence without filling in a causal explanation the evidence does not supply. We must also preserve the people for whom neither change completes an answer.

If my government does not ask for me

So far, states hold the microphone. What if the people affected could bring a question themselves, without waiting for their foreign ministry to consider them worth representing?

During the war, a UCSE strike hit a station waiting hall in its neighbor’s territory. The countries published different civilian death counts. UCSE later established a compensation fund, but eligibility covered its own citizens and lawful residents within its territory. Twenty-seven bereaved households applied and were excluded. In another part of the case, 311 farming households held receipts for grain taken during the war. The receipts promised postwar settlement. The defense office still had no settlement arrangements.

The families and farmers had tried national routes. The fund rejected the families; the complaints office would not admit their complaints; the defense office said the settlement procedure had not been established. The problem was not that nobody had knocked. The doors offered no usable way forward.

They authorized lawyers to submit petitions directly to the Three-Borders Petitions Committee. Their state later sent a letter supporting them, but their access did not depend on that letter or on diplomatic transmission. That small procedural difference is the difference between having a route and hoping someone else will carry a message.

The committee did not claim jurisdiction over everything. The strike preceded the relevant provision’s entry into force and was not admitted for review. The later application of the compensation law and the continuing failure to settle receipts were admitted. A procedural limit does not erase the earlier harm; it identifies what this particular route can reach.

Three practical questions help test the route. Can the respondent block admission on its own? Can the people actually initiate it? Can they do so without retaliation? Members holding UCSE nationality take no part in examining these petitions, and the committee decides that no usable domestic remedy remains. The case contains no account of retaliation. That is an absence of information, not verification that retaliation never occurred.

The committee issues an opinion. UCSE later changes eligibility, pays for the grain, and supplies an edited document about the strike. Those are changes worth recording. Nineteen households receive compensation. Eight are rejected because the dead person’s civilian status cannot be established. The farmers say payment at the old grain price leaves them thirty percent short. The complete targeting memorandum is not disclosed.

An opinion is not a complete remedy. This committee issues opinions rather than judgments; its members’ duties depend on the undertaking actually accepted. We should neither equip it in the telling with the full powers of a court nor treat its lack of those powers as proof that it has done nothing. The useful account distinguishes what reached the decision-makers, what changed, and what still has no adequate answer.

And who questions the conference?

A system that can question national governments but cannot itself be questioned creates a curious escape. States must answer separately; together they somehow become nobody’s decision. The shared purpose becomes a place to hide.

People fleeing the Sandbars reach Stonegorge and are housed in Eastfield camp. The members’ conference adopts a plan for sharing transfers. Destinations are assigned by household lottery, with adult children counted as separate households. Refusing the assigned destination means losing that year’s eligibility. Forty-six households with relatives in northern NUT draw other destinations. Thirty-one refuse and remain in camp. In nine households, adult children and parents are assigned to different countries.

The office explains that the lottery distributes places, not people, because everyone may refuse. The sentence does not settle the practical question. What remains after refusal? Can a family stay together? A formally available no may carry consequences that require examination.

Some affected residents petition against the conference’s own decision. The secretariat argues that the petitions provision does not reach such decisions. The committee, by a majority, admits the case. Had the secretariat’s interpretation been conclusive, the common arrangement would have closed the door on a question directed at itself.

The conference subsequently lets adult children and parents count as one household and preserves next year’s eligibility after refusal. Siblings still cannot combine as a household. The year already lost is not returned by the new rule. An arrangement capable of amendment is not an arrangement whose problems have all been amended away.

Some questioners live outside the member states altogether. A common measure suspends commercial traffic at the Grey River crossings while exempting people and humanitarian supplies. In practice, permits average 41 days, and water-purification chemicals are classified as dual-use goods. A clinic and villagers on the outside bank petition too. If membership alone determined who could ask, the measure could cross the border to affect them while their question could not cross back.

The rules are subsequently revised: a shorter permit deadline, removal of the restriction on water-purification chemicals, and a humanitarian market. The earlier months of interrupted medicine and closed businesses still belong in the account. The conference that made the measure and Stonegorge’s office that administered permits must answer for different parts. Neither can send people in a circle by pointing only to the other.

Even these routes are not permanent guarantees. Later in the fictional history, a member withdraws from the individual-petition arrangement and new petitions cease to be admissible. Losing a route is a real loss; saying that questions remain possible elsewhere cannot make it trivial. But withdrawal cannot also erase prior conduct, the record of non-response, or the people still asking.

Perhaps the most valuable thing about an agreement is not that everyone once managed to say the same words. It is that afterward someone can still start from a birth certificate, a receipt, a camp, or a clinic and bring an unfinished question back to the people who made the decision.
