Who Answers After the War?
The records are withheld, the families still have questions, and some officials have left office. Accountability cannot depend on any of those questions going away.

The countries, places and events in this series are fictional cases from the source papers. The essays develop a philosophical argument, not an account of current law or a judgment on a particular country. No prior reading is required.

The inquiry asks for wartime files. The Office of Defense and the internal security office withhold some, citing serving personnel and intelligence sources. The committee has no power to compel production. It petitions the Final Court. The case is pending.
This is the fictional UCSE after the war. A newly elected legislature has created a fifteen-member committee to examine the river crossing, the order against organized evacuation from Reedtown, the Junction Town strike, buffer-zone detention, and the wartime constitutional referendum. Matters once said to be too urgent for questions now require doors to be opened one at a time.
The former First Executive testifies that every decision went through the Council of Three and rested on legislative authorization. The state’s survival, he says, was the highest reason. The chief prosecutor observes that existing law contains no offense specifically directed at wartime decision-making itself. Relatives of those killed at Junction Town submit statements through the liaison office at Three Borders. The committee debates accepting them, then does.
Two shortcuts suggest themselves. If there is no specific offense and decisions were authorized, perhaps nothing more can be asked. Or, because people were harmed, perhaps everything can be charged to the three people who sat on the council. Neither shortcut will do.
An answer has to reach action
No higher government does not mean no one can question the state’s highest offices. What stops a question is often quite ordinary: an implementation order never issued, an expiration date tied to an event that may never occur, a review that needs permission from the very office being reviewed.
After the ceasefire, the Final Court ordered an election within six months. The Executive Council said it respected the judgment but would not issue the election order until the legislature formally ended wartime status. Member units willing to prepare the vote were blocked. The Charter provided no substitute when the responsible office refused to implement a ruling. The last court had answered. The power to decide when voters could vote moved, in practice, to the office doing nothing.
Power appears not only in orders but in an omission nobody else can overcome. An institutional design must therefore provide an implementation function independent of the refusing body. Its form is open to design; its existence cannot remain at the refuser’s discretion. Disagreement should enter review, not become a unilateral veto through noncompliance.
Wartime surveillance offers another version. Originally authorized by the internal security director without a court, it was extended until a peace treaty with the DRP. There was a ceasefire and a withdrawal agreement, but no peace treaty. The authorization remained. In this case, the attackers had withdrawn and hostilities had stopped; the original defensive ground had ended. Any continuing peacetime function needed a fresh basis, limits, and review, not indefinite life borrowed from wartime authority.
A secret measure reveals a further problem: someone who does not know they are being monitored cannot initiate a complaint about it. Review must also be startable by an independent office without waiting for the affected person to discover the act or the security office to consent. The UCSE Charter allows member-unit governments or a quarter of legislators to request judicial review. Whether that route can actually reach the secret measure is the practical question.
A list of courts, inspectorates, and committees is not enough. Who can initiate the process? What can it change? Can the respondent close it unilaterally? Where does responsibility remain if it fails? A missing answer can turn a well-labeled institution into another window that forwards the applicant elsewhere.
The families cannot depend on goodwill
Accepting the Junction Town families’ statements matters. They are asking who approved the 7:40 strike, why passenger timetables were not verified, and why their relatives died in a waiting hall. They could not avoid the strike. Living abroad does not diminish their standing to seek an account from the state whose action reached them.
Yet this successful delivery depends on two acts of willingness: the liaison office agrees to forward it; the temporary committee agrees to receive it. Either refusal would break this route. The record does not establish another available route for everyone in their position, and the Inspectorate’s ordinary jurisdiction does not automatically include them. A door opened once by goodwill is not yet a door that affected people can open for themselves.
The DRP government also demands compensation and the surrender of the three council members for trial. That is a different kind of request. Absent a separate obligation, a state may refuse an ordinary diplomatic demand. Duties under an accepted treaty or common procedure still apply. Neither side of that distinction disappears merely because the countries have no common superior.
Refusing the other government does not answer the families. The decision not to reply remains a domestic decision open to scrutiny, while the underlying strike remains a UCSE action. Nor does a former enemy’s question become meaningless because it comes from a former enemy. One need not trust the questioner to investigate the fact being questioned.
Legislators are considering a victims’ compensation fund and debating whether it should include DRP civilians. This argument does not determine the fund’s complete eligibility rules or payments; those belong to concrete law. It does rule out treating ‘foreigners’ as a sufficient explanation for exclusion. If they are excluded, the reasons must address them too, not end inside the legislature’s own discussion.
Citizens encounter a parallel evasion: if you dislike the country, leave. Exit must be genuinely possible, but relinquishing citizenship cannot explain why an election was delayed. Using the most costly route to dismiss a question is not respect for exit. The opposite demand is wrong too: people facing danger cannot be required to exhaust complaints and lawsuits before leaving. Exit and challenge stand alongside each other. Neither should be used to drive people toward the other or lock them out of it.
Institutional checks and personally accessible complaints need each other as well. Courts, legislators, and inspectors may possess powers but decline to initiate scrutiny. Individuals may ask but need an empowered office to make something happen. Different arrangements can serve these functions. Independence, accessibility, protection against retaliation, and an ability to affect the matter cannot simply be selected à la carte.
Responsibility without inventing a crime
The former executive’s appeal to authorization answers a procedural question: who was empowered, through what process? It does not settle necessity, scope, harm, or continuing obligations. Calling survival the highest reason cannot close those questions. A state is worth maintaining for the people whose lives it supports and affects; its continuation is not a separate overriding reason against them.
This does not convert every institutional failure into a particular person’s offense. A missing substitute implementation mechanism belongs to the institutional design. Refusal to execute a judgment belongs to the relevant office. A signature, affirmative vote, or recorded objection belongs to an individual’s conduct. The state’s name must not conceal independently grounded personal responsibility, but state failure must not automatically be emptied onto three people either.
The External Affairs executive twice dissented; the former defense chief submitted a written objection. Public records preserve these differences instead of melting them into a collective will. Reedtown’s deaths also require distinctions among DRP shelling, the UCSE evacuation order and delayed passes, and the fighting itself. Entanglement is not a reason to charge every consequence to one source or to record none.
Leaving office does not erase the record. The successor government transmits documents because the institution continues to answer for what was done in its name. Any independently grounded responsibility of the former officeholder also remains. Succession ends occupancy, not the question of what that occupant signed or did.
Responsibility is not identical with punishment. This argument requires at least three things: decisions and reasons made public, with records attributable to offices and people; an independent, accessible, nonretaliatory route through which affected people can ask and receive answers; and stricter confirmation for future decisions of the same kind by offices that failed. Further civil, criminal, or other legal liability belongs to the applicable law. Philosophy does not invent an offense after the event.
Those requirements are substantial. Records without access are an archive. A hearing without possible change is a gesture. Replacing a person while preserving the same failure leaves the next occasion waiting. Stricter confirmation changes how an office decides; it does not declare everyone who occupied it guilty. Compensation also deserves examination, but its whole arrangement does not follow automatically from this minimum account.
West Flats farmers illustrate the difference. Their land was requisitioned three years earlier at one-third of market value, with compensation to be reconsidered after the war. Their lawsuit failed at final judgment; the acting Inspector-General consequently refused further involvement. The defense office still uses the land. But the promised condition—after the war—has arrived. Closing one lawsuit cannot immunize the compensation rule, recusal process, or continued failure to begin reconsideration. One temporary hearing cannot replace a route that remains usable.
Some withheld files may genuinely contain secrets needing protection. How much can be withheld cannot be settled forever by the withholding office alone. Petitioning the court lets another part of the system reach what the committee cannot. A pending case proves neither that wrongdoing is established nor that delay clears responsibility. This network does not guarantee that every deadlock ends immediately, and it cannot solve the problem by assuming an all-knowing, permanently innocent person at the top.
The series therefore ends without certifying an ideal state. Its fictional countries have impressive names; their actions still need examination one by one. Highest rules, last courts, military command, and war all require decisions. None gains immunity because no higher tier exists. Peace has not answered the families. Authorization, retirement, and the absence of a dedicated offense have not answered them either. Their questions need somewhere to continue, and the responsibility they reach needs an address that can still be found.
