A Letter from Upstream
A river does not stop at a border. Neither does responsibility for what a state sends downstream.

The countries, places and events in this series are fictional cases from the source papers. The essays develop a philosophical argument, not an account of current law or a judgment on a particular country. No prior reading is required.

The downstream government sent a demand: stop building the reservoir, or guarantee the old flow. The reply from upstream began with a different question. What was the downstream country doing with its own water?
The dispute belongs to the fictional case running through this series. The United City-States of Ends, or UCSE, lies downstream; the Nation Union of Telos, or NUT, lies upstream; the Democratic Republic of Purposes, or DRP, is the western neighbor. None of their impressive names settles whether a particular action is defensible.
The Cloud River runs from the NUT through the UCSE to the sea. A long-standing agreement guarantees a dry-season flow of at least 180 cubic meters per second at Eagle Gap ‘in normal years.’ When the NUT proposes filling a new reservoir over three dry seasons, the UCSE estimates a flow of about 150, higher pollutant concentrations at Willow Ferry, and saltwater pushing farther inland at Rivermouth City.
The NUT asks what counts as a normal year. It also asks why irrigation withdrawals in the UCSE have risen by about thirty percent over a decade, and why more upstream water should dilute wastewater discharged by Apple City. These questions do not absolve the reservoir’s builders. They do make one thing harder: telling the story as though every relevant action occurred on the other side of the border.
An agreement without an overlord
There is no government above both countries to decide the matter. But there is an agreed route: a joint commission, followed by arbitration if six months bring no settlement. That route stalls because the list of prospective arbitrators has expired. Eventually both sides agree to use the old list, renewing their acceptance of the procedure for this dispute.
The tribunal permits the reservoir to fill, sets a minimum flow of 165, and requires upstream water data to reach the downstream country within an hour. It declines to decide where Willow Ferry’s pollution originates: that falls outside the agreement. Both countries face domestic objections. Both ultimately comply.
The arrangement is imperfect, but not empty. No common government does not mean no binding rules. An agreement identifies the procedure; an accepted procedure produces an award; institutions in each country implement it. The award settles this case, not every future year or every problem along the river. Nor does it make the officials accepting and implementing it unanswerable. Withdrawal from an agreement would itself be a fresh decision, requiring reasons rather than the announcement that nobody stands above the state.
At one point the UCSE offers a trade: if the NUT joins sanctions against the DRP, the UCSE can withdraw its water arbitration request. The NUT replies that the two matters should follow their own procedures. Diplomacy involves bargaining, certainly. But whose question would this bargain dispose of? The people at the downstream intake might lose their claim without receiving an answer about their water. Success in an unrelated negotiation would not supply that missing answer.
The people an order reaches
Once war begins, the UCSE closes the western trade route, freezes DRP state assets, and prohibits transactions with three DRP banks. Humanitarian goods are exempt. The Executive for Trade assures legislators that the target is the enemy’s war-making capacity and the exemption remains open.
It does remain open on paper. Food and medicines can receive licenses, but processing takes an average of seventy-four days. Medical cold-chain equipment is refused as dual-use. Even licensed shipments often cannot be paid for through the prohibited banks. Border health stations report that dialysis has fallen by about half in several DRP districts; flour prices in the north have risen by about sixty percent.
Those figures call for investigation, not a sweeping attribution. Fighting, the DRP’s own mobilization, and alternative supplies may also affect treatment and prices. The UCSE can start with what its own offices control: the licensing delay, the equipment restriction, the payment blockage. It must then establish whether those restrictions actually prevented particular treatments and whether workable alternatives existed. Multiple causes are a reason to distinguish responsibility, not to make one’s own contribution disappear.
A patient needing dialysis cannot live on the existence of an exemption. If these restrictions are what prevent treatment, ‘humanitarian goods excepted’ has not excepted that person in practice. An order can reach someone it does not name as its target. Permission to import is not the same as a machine arriving, a payment clearing, and treatment starting.
Citizenship does not settle this responsibility. When a state’s action reaches a person who cannot avoid it, that state owes an answer about that action. This does not give the patient UCSE citizenship or give the UCSE authority over the rest of the patient’s life. It means that bodily safety and the ability to challenge what is happening do not diminish with a different passport. Other positive responsibilities depend on the actual relationship and how much life the state organizes; not every obligation becomes identical across borders.
An importer’s ability to seek a license is not yet the patient’s ability to challenge an unusable exemption. Nor is a health station reporting figures on the patient’s behalf. There must be a reachable route, independent of the department imposing the restriction, through which the patient or treating doctor can obtain review without retaliation. Its institutional form remains open. Its function cannot be replaced by the department’s assurance that the door is already open.
There is a second distinction here. Preventing harm one’s country causes is not the same as acquiring the right to redesign another population’s future. Aid and repair cannot quietly become a demand that those people become the people we prescribe. Neither their government’s conduct nor our concern for them supplies that authority. The separate question of rescue in another country deserves an argument of its own, not dismissal under a slogan of noninterference and not a blank authorization to intervene.
An opponent is not a moral yardstick
The NUT later asks the UCSE five questions, about a station strike, buffer-zone detention, border deaths, drinking water at a reception center, and the removal of a commentator’s citizenship. The UCSE supplies some information and invokes security, local responsibility, or domestic affairs for the rest.
For an ordinary diplomatic inquiry, absent a separate duty to respond, a country may decline an answer. Existing treaty commitments to answer or implement decisions still bind it. More importantly, declining to answer a neighboring government does not dispose of the affected person’s question. ‘Domestic affairs’ identifies responsibility; it does not end responsibility. In the reception-center case, the state points to the regional authorities, who have already forwarded the complaint back to the state. The question completes a circuit without reaching an answer.
A diplomatic inquiry is not, by itself, an accessible complaints procedure. It may be independent of the state being questioned, yet affected people may be unable to initiate it or secure protection against retaliation. Diplomacy can bring their questions to the door. An independent, reachable domestic route must carry them farther.
Maintaining relations is not endorsement, either. Even while fighting, the UCSE and DRP keep liaison offices at Three Borders. Ceasefire and withdrawal negotiations take place there; relatives’ statements later travel through them. Recognition preserves an address to which actions and responsibility can be attributed. It neither licenses shelling nor transfers responsibility for shelling to every third country that maintains contact. A third country’s own trade policies can be questioned separately.
Under threat, comparison offers a tempting refuge: they are worse; we have been restrained. Yet the DRP’s repression cannot answer for a UCSE editor sentenced to eighteen months because an interview with a DRP mother placed her soldier son’s death beside the UCSE’s defense. On that stated ground, this particular judgment crosses the boundary: it does not regulate the timing or manner of expression but dictates what perspective readers may have. A mother’s loss cannot cease to be describable as a human loss because she lives in the enemy country.
That does not establish a verdict on every wartime measure. High defense spending calls for scrutiny of present reasons and oversight, not condemnation by percentage alone. A refused demonstration needs its actual grounds examined. Requiring attendance at a defense course does not establish compulsory belief without knowing its content. Judgment belongs to what was done, not to a country’s name or alliance.
The upstream letter does not prove that the upstream country is always right. It makes a smaller, more useful point. Being entitled to question another state does not remove one’s own actions from the inquiry. Rivers keep crossing borders. Orders reach people beyond their stated targets. Whether a state remains answerable depends not simply on whether it sends a reply, but on whether those people have somewhere to take the question that the reply leaves unanswered.
