The day after the judgment, the First Executive says that the Executive Council respects the Final Court. Then comes the qualification: until the legislature formally terminates the state of war, no election order will be issued.

The court has been clear. A ceasefire is in force. For the clause postponing elections, the state of war ended when armed hostilities stopped; an election must be held by autumn. Six judges agree, five dissent. The dissenters argue that the majority has rewritten the Charter rather than interpreted it. The executive shares that view. So the majority’s binding judgment goes unimplemented.

We are back in the fictional United City-States of Ends. Its eleven-member Final Court hears Charter cases as a full bench. The Charter says its judgments bind every public body. It does not say who acts when a body refuses. The Chamber of Citizens’ term should have ended the previous winter. Its members remain in office, and the First Executive’s extended term runs with theirs.

Election commissions in the Kingdom State and South Bay State offer to prepare the vote. The council replies that member units cannot organize a national election. Nothing happens. Only the following summer, after a withdrawal agreement, does the legislature set a new date. The election finally takes place a year after the court’s deadline.

This is not simply an argument on paper. Voters have lost a year in which they should have been able to question their representatives through an election. If a final judgment becomes effective only when the losing office agrees, that office still holds the final veto.

Final for the case, not beyond correction

Courts are not infallible. The five dissenters may have a serious argument. The majority may be wrong. But a court may be wrong does not entail that the losing public body may decline to comply. Otherwise every office could find a rival interpretation and make the judgment’s effect conditional on its own approval.

An operative judgment that must be carried out should be carried out. The executive can explain its disagreement publicly and propose changes to future rules. If it believes compliance itself would violate someone’s fundamental boundaries, it can raise that objection openly and send it into review it does not control. Until that review changes the operative decision, the decision stands. An emergency does not supply a separate power to suspend it.

This is a responsibility of office, not a philosopher’s command to an official’s conscience. A person may refuse or resign, and the system must leave room for that person’s position to be heard. But personal refusal cannot confer on the office a power to nullify the judgment. There must therefore be an alternative way to implement it, one that can be activated without the refusing body’s consent and cannot be stopped by that body.

No second army is implied. In this case the missing acts are an election order and the organization of a vote; two election commissions have offered to help. Authority and activation require concrete design. The alternative function is limited to implementing the judgment, remains reviewable, and must not become another unaccountable center. Its existence guarantees no magical success. What cannot count as an alternative is a route that still waits for the refusing office’s permission.

Conversely, mandatory compliance does not exempt the court from challenge. A case decided on the same grounds can end. New evidence or a new question can support renewed review. Judges can be held to account for bribery, abuse, or neglect. Rules can be amended for future cases. Public criticism does not require the court’s prior permission.

A last court closes a dispute, not every route toward correcting it. People need decisions they can act on now, and ways to confront mistakes afterward. Keeping one does not require surrendering the other.

Seven judges say no

Another emergency order allows people suspected of assisting the enemy to be detained without prosecution for thirty days at a time, repeatedly. Seven judges find the provision contrary to the Charter. Four disagree. Seven is a majority—but the Fourteenth Amendment requires eight votes to invalidate an emergency order. The provision stays in force. By then 640 people have been detained under it, the longest for 150 days.

It would be inaccurate to say that the government has ignored a judgment striking down this order. No such operative judgment was made. Under the rules then in force, the court did not invalidate it. The seven judges’ objections survive as reasons, not as a decision ending the provision’s application.

Yet procedure does not settle the whole question. The threshold has changed something concrete: between a simple majority and eight votes, review that could have produced corrective action now produces reasons alone. Review still exists; one case does not establish that it has become entirely meaningless. A threshold making correction practically impossible would reduce it to a label. Here we can say something narrower and certain: seven judges’ objections did not get the detained people released.

A further detention is a further decision. New evidence, new questions, or the end of the wartime threshold can create grounds for another request. The court can decide whether a particular request is new. It cannot permanently exclude a whole class of questioners. Proposals to change the rules remain possible without retrospectively reversing a completed judgment.

Accountability can become pressure

After the election judgment, the Chamber of Citizens impeaches the Chief Judge who wrote the majority opinion. Its stated reason is a private conversation during the court’s deliberations with the governor of South Bay, a party to the case. The conversation lasted about twenty minutes in a law school’s graduation reception room. Two teachers present say they heard no discussion of the case. The judge and governor say they talked about the ceremony and a retired judge.

The account does not let us decide whether this was misconduct. It does let us distinguish questions. A judge’s conduct can be examined. Disliking a judgment cannot by itself justify removing its author. Otherwise impeachment bypasses the requirements for reopening a case or changing future rules: no new evidence, no amendment, just a different judge. The judgment may still be evidence of bribery or abuse. What is excluded is treating an unwelcome conclusion as misconduct in itself.

Three of the four leading sponsors represented the parliamentary majority in the very case the judge decided. Those three should take no part in initiating or hearing this impeachment; proof of a private desire for revenge is not required. The conflict concerns the particular representatives, not the legislature as a whole. Disqualifying the entire body whenever it has been a party would shield judges from accountability even for bribery in those cases. Whether the charge is genuinely separable from displeasure at the judgment cannot be settled by the initiating side alone.

The impeachment also suspends the Chief Judge automatically. For three months, ten judges hear the remaining cases. The required conviction threshold is not met, and the Chief Judge returns. We cannot know how the absent judge would have voted. We can see that the initiating chamber’s majority has altered the composition of a court reviewing its actions. Suspension may have protective reasons, but it too cannot depend solely on the party initiating impeachment.

The routes for questioning judges must remain open. So must the court’s ability to review others without retaliation. The phrase judicial independence does not reconcile these needs automatically. We must ask who initiates, who decides, and who can close the route.

A separate case makes that inquiry more intimate. Forty-three farming households challenge compensation for requisitioned land, set at one third of market value, with further discussion promised only after the war. One panel judge previously advised that the very compensation schedule was constitutional. The farmers seek his recusal. Under the court’s rules he decides that application himself. He refuses, saying his earlier opinion was general, not about these particular claimants. The suit is dismissed three to two; he is in the majority.

We cannot conclude that he was biased. His explanation might be right. The structural difficulty is that the person questioned is the sole decider of whether he can hear the case. It would remain a difficulty had he been in the minority. A domestic court is not automatically dependent merely because it belongs to the same state as the defendant. Neither does the word court establish independence. The inquiry must reach the actual rule, office, and person involved.

After judgment the farmers complain to the Inspectorate about the compensation rule and recusal procedure. They are told that the case is final and will not be taken up. But an inspectorate unable to reverse the judgment can still question a rule or ask when after the war will arrive. In Year 12 the land is still in use and the promised discussion has not happened.

Interpretation likewise cannot become a second power to write the constitution. Whether a reading has crossed into amendment remains open to challenge, later cases, and lawful changes to future rules; neither the court nor its dissatisfied opponents may settle that question forever by themselves. Even declining to interpret has consequences: it lets an existing interpretation run for now. Not yet ripe cannot become a permanent refusal to answer.

These arrangements do not promise that every deadlock will be solved immediately. The UCSE’s election was still a year late. Holding it eventually does not turn that year of noncompliance into compliance. The missing alternative route is an institutional failure; refusing the order is an entry against the responsible office. A judgment may be finished while people are still living with its consequences. Some questions begin there.
