Withdraw Cooperation, Not the Way Out

A neighboring government stops holding elections and refuses to carry out judgments. Withdrawing help can be justified without making flood warnings, refuge, or a way to ask questions the price ordinary people must pay.

The proposal is easy to state: suspend the hourly transmission of upstream river data to put pressure on a neighboring government. The difficulty begins when we ask who needs the warning. Downstream residents did not decide to suspend an election. They cannot make a court judgment take effect. Rising water reaches them nevertheless. Interrupting their warning does not put the decision-maker's hand under ours.

In the fictional world of the State essays, the neighboring Nation Union of Telos, or NUT, rejects this proposal by four votes to one. Its refusal matters because it is already considering ways to withdraw cooperation. A choice not to help certain official actions need not become a choice to make every connection unsafe.

First, however, the story needs a clear branch point. In the original UCSE case record, the slide stopped before the paper's proposed threshold was reached. Wartime status ended and elections resumed. This essay follows a counterfactual developed in the companion paper: suppose those events had not occurred. These are invented countries and institutions, not a disguised account of a particular contemporary state.

A judgment about routes, not a national identity

In that alternative branch, the Chief Judge is removed in the winter of Year 10, and the Final Court is left with ten judges after attempts to appoint a successor fail. No withdrawal agreement follows in Year 11. Intermittent hostilities continue; wartime status remains in place, elections do not return, and the Executive Council keeps renewing emergency powers. The decisive additional step comes that winter: Emergency Order 31 makes a nationwide referendum depend on an executive order issued as military conditions permit.

Previously, four member-unit legislatures could jointly initiate an amendment and arrange a referendum without going through the Chamber of Citizens. The executive now claims the power to decide when the vote can happen. A route for restoring accountability has acquired the very dependency it was meant to avoid: the party being questioned must allow the correction to proceed.

With all four movements described earlier present, the paper proposes examining five restorative routes: elections, judicial review capable of affecting the relevant acts, oversight, ending emergency and wartime status, and changing the highest rules. We must ask not only whether an office exists or a hearing occurs, but whether a result can be reached and implemented without permission from the positions under examination. Control over implementation can obstruct a valid decision even where the decision itself was independently made.

This is the author's suggested procedure, not an established legal test for every country. It also does not turn unfair conditions into automatic proof that every corrective route is closed. A route that remains capable of restoring accountability without the target's consent is significant even when using it is unfairly difficult. Conversely, the ability to block one further amendment need not reopen powers already withdrawn from scrutiny. Exit matters too, but leaving a relationship does not itself restore its accountable structure; it serves a different purpose from these five routes.

Counting people cannot replace examining the structure. If most residents can still vote and go to court while a particular population loses several routes at once, the majority's ordinary experience cannot make that exclusion disappear. What matters is how the relevant decisions operate for those affected. Conversely, a recognizable list of symptoms still has to be checked against actual powers, seats, and implementation. Resemblance alone cannot establish that no route back remains.

Party labels cannot settle the inquiry. A legislative majority that enacted the measures and then removed its own exposure to elections must answer for its actions. We need not first establish that it is an executive puppet. Equally, sharing a party or voting alike does not by itself prove that two offices have become one functional authority. Appointment relationships alone do not prove control either.

In this branch, elections remain suspended, and ending wartime status cannot pass without votes from the majority being questioned. The Inspectorate can still request files and issue reports, but cannot itself reverse a decision; corrective results depend on judicial review and implementation. In the summer of Year 12, the court's ten judges find Order 31 unconstitutional by eight votes to two. The judgment is valid and independently reached. The executive says it respects the court but postpones the order's lapse until wartime status ends. No alternative enforcement route exists. This is a failure of implementation, not evidence that the court ceased to be independent. Refusal also does not confer a lawful executive veto or invalidate the judgment.

NUT's decision that spring cannot be justified with knowledge of this later summer ruling. At the time, it could consider the earlier unimplemented election judgment, the existing enforcement gap, Order 31, and votes already taken. The reader who knows the whole branch must not quietly lend its later facts to an earlier decision-maker.

The paper reserves the broader response to the slide as such for a peer that has recognized this closing of restorative routes. Before that recognition, symptoms do not warrant that level of response. This is not a demand for silence beforehand: questions, records, and necessary withdrawal of cooperation connected to particular acts remain possible. Distinguishing the two prevents both premature generalization and an invented obligation to help every specific act until the whole structure has changed.

Which cooperation, and at whose cost?

NUT does not acquire authority to select UCSE's government. It continues to recognize where official actions originate and to attribute them to the offices that undertake them. Recognition in this limited sense is neither approval nor a license. Nor does it turn a state into a person with an ultimate claim upon others. An institutional arrangement and the people living within it must not be collapsed into one judgment attached to a name.

In the imagined branch, NUT stops processing judicial-assistance requests under the speech and denationalization provisions, pauses negotiations on a new trade protocol, and requires licenses for dual-use exports to UCSE's Office of Defense. It publishes its questions and the replies. The liaison office, visa-free travel, hourly river data, and space for people leaving UCSE or stripped of its citizenship remain. Distance increases without every channel being severed.

Refusing the specified judicial requests addresses identifiable actions: prosecutions for speech and the enforcement of denationalization. It is not a restriction on every person holding a UCSE document. Still, the case does not supply the relevant treaty text. Whether refusal, suspension, or termination is the appropriate legal form cannot be decided by philosophical approval of the direction. The missing clauses cannot be filled with our preferred conclusion.

The trade pause poses a different problem. Existing trade continues; NUT withholds a further arrangement not yet granted. Yet a dissenting member asks whether the lost opportunities fall on northern merchants while leaving the executive untouched. The record does not establish how well the measure reaches its intended target. Keeping that question open is part of examining the response, not a failure to take a position on the original acts.

Export licensing aims at the Office of Defense's procurement. That does not exempt its design from attention to civilian consequences. The absence of a reported spillover is not proof that no one could be harmed. Any effect on basic conditions of life would need separate examination. A statement that the target is correct cannot settle who actually bears a restriction's cost.

River data makes the limit tangible. It is both a fulfilled arbitral obligation and a basis for flood warnings downstream. Suspending it would use other people's safety as leverage over offices they do not control. Rejecting that proposal does not require NUT to keep assisting a speech prosecution. What remains and what is withdrawn can be judged separately rather than bundled into complete cooperation or complete isolation.

There is a serious objection to distancing: might it cut people off from the outside and help their government depict every foreigner as an enemy? That risk deserves consideration. But preserving contact, questions, refuge, and travel does not require preserving every form of official assistance. NUT cannot determine what another executive will say. It can avoid supplying a true example of collective punishment to support the claim.

Two accounts must therefore remain distinct. UCSE's officials answer for their acts. NUT's External Affairs Council answers for the design and effects of its response. The second account is not cancelled by the first. We cannot place every avoidable injury under the heading of what the other side made us do. Responding to a slide does not authorize reproducing it at home.

The person at the border is not a country name

Later that summer, NUT approves additional entry screening for UCSE nationals, retaining exceptions for humanitarian grounds, dissidents, and people deprived of citizenship. Approval within the story does not establish that the arrangement passes examination. An exception printed on a page needs someone able to grant it, a usable timeframe, and a route for questioning refusal. Without those, an apparently open door can be impossible to reach.

A person being subjected to this entry decision is already affected by NUT's action. Standing at its border does not place them outside every claim upon the authority making that decision. The paper distinguishes allocating entry from defense. This grants no automatic answer to every admission request; it prevents a defensive label from replacing an examination of the particular restriction and its consequences.

UCSE nationals already living in NUT cannot be treated as a suspect category merely because of that nationality. Withdrawing dealings with official representatives is different from making all similarly documented residents report to the police. If the response begins by converting people into a convenient group identity, the responder has already performed a version of the simplification it opposes.

People leaving may also disagree about outside pressure. Some request it; others fear its effects on relatives who remain. Both can be speaking seriously about their own circumstances. NUT may hear them and provide channels for their questions without treating one group's request as permission to decide for everyone. Its council still has to examine the acts it chooses to undertake.

Conditions for restoring cooperation must likewise address the acts and their accountability, not demand acceptance of an externally authored future. Particular measures can cease and particular forms of cooperation can return. A promise or announcement alone does not establish that the relevant change occurred. But neither can the neighbor quietly add a requirement to adopt its preferred direction before reopening relations. Deciding whether to help is not ownership of another people's future.

The slide itself supplies no reason to go to war. A cross-border attack would raise a different question under its own stringent conditions; institutional regression cannot substitute for those conditions. A peer is neither a superior court nor an automatically qualified rescuer. Its reputational judgments and withdrawals are actions for which it answers, not punishment administered on behalf of a nonexistent superior.

If relations later improve, recognition, cooperation, and the record remain three different things. Resuming a particular exchange does not make earlier decisions disappear. Preserving the record does not predetermine that every wrong must lead to prosecution. Which cooperation returns, and when, requires judgment; reconciliation cannot settle every affected person's history by declaration.

Nor does this account hand ordinary people a compulsory program of resistance. Those who leave are not required to remain instruments of a cause. Repair belongs to the people there and the routes they can make their own. Outsiders can leave space in which a question is heard and a person can find safety; they cannot prescribe how that person's life must continue.

The hourly data keeps arriving. This is not a symbol that nothing has changed. It gives refusal a boundary it can be held to: there are acts we will no longer help you carry out, and there are other people's lives and ways out that we will not use to settle the account.
