Another storefront is not necessarily another usable route. Amazon's pricing and fulfilment dispute asks how valuable integration can remain open to challenge.

The dispute in Amazon's antitrust case is not simply whether a seller can open another store. It is about what can travel with the seller: access to customers, room to price differently and a workable way to fulfil orders. Registering an account elsewhere and sustaining a business there are different achievements.
Begin with a small part of the product page. Several sellers may offer the same item, but a prominent purchase position highlights one offer. The filings use the familiar name Buy Box; shoppers may also encounter Featured Offer. For a customer it shortens the search. For a seller, the route by which an offer reaches that position can matter a great deal.[1][4]
Behind the offer sit Prime's service promise and eligibility requirements, and Fulfillment by Amazon, or FBA: services through which Amazon handles work such as storage, packing and delivery. Display, membership and fulfilment interact, but they are not the same thing. Combining them into one vague idea of a platform conceals the decisions we need to examine.[1][3]
The FTC and state plaintiffs sued Amazon in 2023 and subsequently amended their complaint. Their case alleges an interlocking course of conduct, including responses to lower prices off Amazon and conditions connecting Prime eligibility to FBA. Amazon rejects the account and argues that the plaintiffs have mistaken competition benefiting shoppers and sellers for harm.[1][3]
As of this essay's cutoff, 1 November 2026, the allegations discussed here must not be presented as an adjudication of liability. The 2024 decision allowing the core federal claims to proceed was an early-stage ruling. An order dated 30 October 2026 still addressed filings for dispositive and expert-evidence motions. That procedural position belongs in the story, not in an easily forgotten disclaimer.[2][6]
The value of putting things together
A small business must do more than make an attractive product. It has to find customers, collect payment, keep stock and deal with returns. A system that takes on part of this work can make a market reachable that was previously out of range. The reasons for joining do not become unreal when the system's rules are challenged.
Amazon's own response deserves to be read at its strongest. The company describes FBA as optional and as the result of substantial investment in logistics. It says sellers can choose other fulfilment methods, and that other logistics services can support the Prime badge when they meet the required delivery standards. A reliable promise to the customer, on this account, needs a reliable means of keeping it.[3]
Its pricing argument is equally recognizable. A retailer should not have to promote an offer that is a poor deal for the shopper. Amazon says comparing prices and declining to highlight uncompetitive offers protects customer trust. Preventing those practices, it argues, could leave shoppers paying more rather than less.[3]
Those explanations should not be treated merely as camouflage. Reliability has to be built, and price matters. A remedy that damages delivery or makes comparison harder has costs it must explain. But a real benefit does not yet establish that every condition attached to obtaining it is necessary. The question is whether the benefit and the particular restriction must travel together.
Size alone cannot answer. A large network may have grown by doing useful work; some of its rules may also make alternatives harder to establish. Both propositions require attention. Popularity does not settle every use of a position, and concentration does not by itself tell us which use is wrong.
When another store is not another route
The FTC's anti-discounting claim concerns what happens outside Amazon. The plaintiffs allege that a seller offering a lower price on another website can face adverse consequences for visibility or promotion on Amazon. That is an alleged mechanism, not a universal effect independently measured by this essay.[1]
If the account is established, a discount's consequences do not remain in the place offering it. A seller considering lower fees and a lower price elsewhere must also consider what happens to access on the original platform. Freedom to open a second storefront can coexist with constraints reaching into how that storefront competes. The causal chain needs evidence; spelling it out identifies what the evidence would have to show.
Amazon asks a powerful question from the other direction: if the same item costs less elsewhere, why should this store feature the more expensive offer? The disagreement is not resolved by deciding that low prices are good. It turns on whether the particular practice, in the relevant market conditions, encourages lower prices or deters sellers from offering them outside. Both accounts cannot be settled by repeating the word competition.[2][3]
The fulfilment allegations add another layer. The complaint says Prime eligibility is important to many sellers and is generally conditioned on FBA. It argues that a seller seeking to operate across channels can then face inventory splitting or additional fulfilment costs, making a single independent network serving several outlets harder to use. These are the plaintiffs' claims about the challenged arrangements, not a description of every present-day seller's options.[1]
The disagreement must remain visible. Amazon says the services are optional and alternatives can work. The FTC alleges that an alternative's existence does not establish comparably usable conditions for the sellers and period it describes. One seller's successful alternative cannot answer for everyone, just as an alleged mechanism cannot supply an invented loss for a particular business.
A usable route has several parts: customers who can be reached, inventory that can be deployed, fees that can be understood, standards that can be verified and a transition that can be financed. Some costs arise from building another network. Others may arise from rules imposed by an existing one. Investigating that distinction is different from declaring every switching cost exclusionary.
The court's 2024 order helps preserve the distinction. On a motion to dismiss, sufficiently pleaded facts are read in the plaintiffs' favour; weighing asserted competitive benefits against alleged exclusionary effects is not resolved on the pleadings. The order does not establish that Amazon's quality and price explanations are false. Nor does it establish the FTC's causal account. It leaves matters for the evidentiary process.[2]
There is an editorial temptation to remove this uncertainty so the story can move faster. Doing so would remove part of the subject. Who has alleged, who has answered and who has decided are different positions. An essay about accountable decisions should not quietly take the last position for itself.
The people who stay can ask too
If a problem lies in the rules, telling individual sellers to leave may not address it. Nor does identifying a problem automatically select a breakup. We can ask more specific questions first. What delivery performance is required? Who must perform it? Which criteria distinguish a good offer, and which criteria tie that offer to another service? A justified standard does not justify every method of administering it.
A separate European proceeding offers arrangements to compare, not a verdict in the American case. In December 2022, the European Commission made Amazon commitments legally binding concerning non-public seller data, Buy Box selection and Prime eligibility and carrier choice. The package also addressed monitoring and complaints.[4]
The Commission's official explanation explicitly distinguishes an Article 9 commitment decision from a finding that EU competition law was infringed. Amazon maintained that its model and practices complied with European law. Neither the decision nor the company's agreement to commitments is an admission of the American allegations. Nor is the announcement proof that every promised improvement subsequently reached sellers.[4][5]
The comparison is useful because it separates tasks. Delivery standards can be retained while asking how independent carriers qualify against verifiable conditions. Data use can be limited by specifying who may use which information. A competing offer can be made more visible rather than merely placed behind another link. Whether these measures work remains an implementation question, not something their announcement settles.
Review needs a route of its own. Who can complain? What information can they obtain? How long does an answer take, and who can revisit it? Having the platform explain every disputed rule is not the only possible design. Moving review outside the platform is not a guarantee of infallibility either. An intervention must explain its costs, as must a decision to leave an arrangement unchanged.
This opens a question larger than exit. Some sellers want to remain. What they need is not advice to become less dependent by sheer determination, but an effective way to question conditions they must meet. Challenging a rule does not deny the value of the service; using the service does not endorse every rule. Dependence can make a voice more necessary, not less legitimate.
The essay does not decide the pending case or turn European commitments into a ready-made solution for every market. It follows the connections between an offer, a delivery promise and access to customers. You can sell somewhere else identifies a possible destination. Whether that destination can become a usable route—and how those who stay can still be heard—requires a further answer.
