The prosecution treats a study group and its books as evidence of subversion. Song answers with ordinary legal work: publication records, university syllabi, warrants, detention dates, medical testimony, and constitutional text. He can win each local argument while losing the trial.
One supposedly incriminating text is E. H. Carr’s What Is History?, legally published, taught at universities, and hardly proof of a clandestine revolutionary organization. Song’s response is devastating in logic: if reading the book is criminal, the institutions prescribing it belong in the dock too.
The prosecution’s theory survives because the book is not doing evidentiary work alone. It is a prop inside a prior story about the defendants.
The students recant. They describe detention without warrants, family notice, or access to counsel, extending over weeks. These are not decorative technicalities. They determine whether a confession can be treated as an authored statement rather than an output extracted by custody.
The court hears the defects and continues. Procedure is acknowledged as language while denied force as a limit.
A military doctor testifies to injuries consistent with torture. The state does not rebut the medical description. Military police instead seize him on the ground that he is absent from his unit, and the court excludes his testimony.
The scene distinguishes refuting a proposition from disqualifying its bearer. The facts he named do not disappear; they lose institutional standing because the person naming them is removed from the authorized position.
When national security is invoked against him, Song returns to the constitutional proposition that sovereignty resides in the people. The line has force because it breaks an abstraction open. “Nation” has been used as something superior to detainees, mothers, and defendants. Song insists that those concrete people are not obstacles to the nation. They are its constituent material.
If protecting the nation requires treating its people as expendable, the word has been detached from the source that gives it legitimacy.
Years later Song is himself prosecuted for participating in a demonstration. The clerk begins reading the names of his defense lawyers. One after another, they stand. The film states that ninety-nine of Busan’s roughly 140 practicing lawyers appeared.
The list does not reverse the earlier verdict. It shows that an action can lose in its immediate forum and still alter the professional world from which future action becomes possible.
Song could not force one court to obey the reasons it heard. He could, however, help form a body of people unwilling to let the next defendant stand alone.

证据是他们读过的书。
其中有一本,是一个英国历史学家写的关于历史学方法的著作。
控方的说法是:这是宣扬那一套东西的书。
宋佑硕做了一件很简单的事。
他查了这本书在韩国的出版和流通情况。
它是合法出版的。
它是多所大学的指定读物。
它被列在某些官方机构的推荐书目里。
他把这些拿到了法庭上。
从纯逻辑上说,这一条无法反驳。
如果读这本书构成犯罪,那么所有指定它作教材的大学、所有推荐它的机构,都在犯罪。
而这一条赢了以后,什么都没有发生。
法官没有采纳。
控方没有撤回指控。
审判照常进行。
第二条:那些认罪的供词。
被告在法庭上翻供了。他们说那些字是在什么情况下签的。
宋佑硕要求核查。
他列出的事实是这样的:
这些人被关了六十多天。
没有逮捕令。
没有通知家属。
律师不能会见。
这些程序上的问题,每一条都成立,每一条都写在法律里。
而法庭的回应是:继续。
这部电影最好的一场戏,是一位证人出庭。
是一名军队的医官,尹中尉。
他在那段时间里,检查过这些被拘留的人。
他在法庭上作证:他看到了什么。他描述了那些伤是怎么造成的,那种伤不可能是别的原因。
他作证的时候,法庭很安静。
这是全片唯一一次,事实被完整地说了出来。
证词说到一半,控方提出了一件事。
他们说,这位证人此刻是脱离部队状态。
宪兵进来了。
他们走到证人席前,把他架起来,往外拖。
他一边被拖一边还在喊,还在把话说完。
门关上了。
法官宣布:该证人的证词不予采纳。
这场戏的构造非常准确。
没有人反驳尹中尉说的任何一个字。
没有人说他撒谎。没有人拿出相反的医学证据。没有人质疑他的专业能力。
他们处理的是他这个人。
他是逃兵,所以他不能站在那里。
他不能站在那里,所以他说的话不作数。
而他说的话,一个字都没有被反驳过。
把这场审判的账算一遍:
关于那本书:他赢了。合法出版,大学教材,官方推荐。
关于程序:他赢了。六十多天,没有逮捕令,没有通知家属,不许会见。
关于伤:他赢了。军医出庭作证,专业,具体,不可辩驳。
每一个回合他都赢了。
而中途法官换了人。
判决下来:有罪。
部分人缓刑。
在庭上,有一次交锋。
对面的那位说,被告的行为危害了国家,说这是国家安全的问题,说律师你不要挡在国家前面。
宋佑硕站起来,念了一条法律条文。
他念的是宪法第一条:大韩民国的主权在于国民,一切权力来自国民。
然后他说了一句话,大意是:
国家,就是国民。
这句话是这部电影里最有名的一句。
它之所以有力,不是因为它慷慨激昂。
是因为它把一个词拆开了。
在那间法庭上,"国家"这个词一直在被使用——用来说明为什么可以不给逮捕令,为什么可以关六十天,为什么可以不让家属知道。
它是一个可以压过任何具体的人的东西。
而宋佑硕做的事情是:他指出这个词是由什么构成的。
它是由被告席上那几个人构成的。
它是由旁听席上那些母亲构成的。
如果"为了国家"意味着可以这样对待他们,那么这个词已经空了。
这一节要把整部电影后半段的结构说出来。
从他接下这个案子开始,不断有人给他台阶。
他妻子说的是家。
他那个记者朋友说的是形势。
税务局的人说得最明白:只要停手,一切照旧。
他的客户一个一个走了。他的事务所在垮。
连对面那位承办的检察官,都劝过他一次。
每一个台阶都好下。
每一个理由都成立。
没有一个人是在威胁他——他们大部分是在关心他。
而他一次都没有下。
这就是上一篇说的那件事:没有人逼他往前走。
是他自己把往回走的那条路关掉了。
这部电影的最后一场,跳到了几年之后。
宋佑硕自己站在被告席上。
他因为参加集会被起诉。
开庭。法官要点辩护律师的名。
书记员开始念名字。
一个人站起来。
又一个人站起来。
又一个。
旁听席后面,一排一排的人站起来。
宋佑硕坐在被告席上,回过头去看。
他的表情变了。
书记员还在念。
釜山地区当时执业的律师,一共一百四十几名。
其中九十九名,在这一天出庭为他辩护。
这部电影到这里结束。
没有旁白解释这意味着什么。
没有音乐推上去。
没有一个人发表演说。
只有一个书记员在念名字,一个人接一个人站起来。
很多年前,这个人在法院门口发名片的时候,这些人当中的大部分看不起他。
而现在他们站在那里。
