Leaving the EU was a decision. Goods, borders and the people entitled to question new arrangements could not all be settled on departure day.
A consignment travels from England to Belfast. Both ends of the journey are in the United Kingdom. Why, then, should anyone need to ask where the goods will eventually be used, or which rules they meet?
This is not a reconstructed scene involving a particular driver. It is the ordinary problem behind an extraordinary negotiation. Goods arriving in Northern Ireland can stay there or move onward into the Republic of Ireland and the EU’s single market. A decision about membership does not rearrange the islands, remove their sea, or bring commerce to a halt.
The UK left the EU on 31 January 2020. The transition period ended that December. Departure was real: continuing obligations do not mean that Britain secretly remained a member. But how departure would work in Northern Ireland required another set of decisions.[1]
Membership ends; geography remains
Two names need separating at the outset. Great Britain is the island containing England, Scotland and Wales. The United Kingdom also includes Northern Ireland. The Republic of Ireland is a different state and an EU member. A shipment from Great Britain to Northern Ireland is therefore internal UK trade, while movement across the Irish land border connects the UK with the EU.
On a blank map, the answer might look straightforward: place the checks along the line. The Irish border is not a line on a blank map. Avoiding a hard border, protecting the 1998 Belfast/Good Friday Agreement, and protecting the single market were all requirements the withdrawal arrangements had to address.[2]
The original Northern Ireland Protocol did not make Northern Ireland an EU member. It remained within the UK’s customs territory while specified EU rules concerning goods continued to apply, with the UK authorities carrying out the relevant controls. The arrangement attempted to accommodate competing requirements, rather than declaring one of them irrelevant.[2]
For a business, the immediate question may be whether a delivery can reach its destination without unnecessary difficulty. That does not license an essayist to invent a stranded shopkeeper and use the story as proof that the entire arrangement failed. Particular burdens require particular evidence. Neither support for Brexit nor opposition to it can substitute for examining where the requirements fall.
This is the difficulty after withdrawal. The previous membership has ended, but a new relationship must still deal with people, goods and legal commitments in the same place. Acknowledging that they have not disappeared is not a denial of exit. It is the beginning of taking exit seriously.
Nor does agreement between two governments settle everything for the people affected. A distinction in the Irish Sea and a hard border on the island carry different implications for different communities. A workable arrangement must confront that lack of alignment. It cannot first announce that everyone’s most important boundary is really in the same place.
Why do these rules still apply?
The dispute also reached the UK Supreme Court. In February 2023, the court dismissed the appeals in Allister and associated cases. Its official summary explains the domestic legal mechanism: Parliament’s legislation, including section 7A of the European Union (Withdrawal) Act 2018, gave the Protocol legal effect within the UK.[3]
That detail prevents a misleading account in which foreign rules simply assert their own superiority over the British Parliament after departure. The court was explaining the consequences of later parliamentary legislation and its relationship with earlier law. The UK had entered a new agreement and legislated for its operation at home.
The legal ruling did not establish that every local objection was groundless. Nor did it identify the best arrangement for every trader. The source of a rule’s domestic legal force and the conditions under which it can retain political confidence are related questions, not a single question that a court answers once for all.
The Windsor Framework subsequently revised the arrangements. Joint Committee Decision No 1/2023 set out changes concerning goods movement and future rules. It provided facilitations, subject to conditions and safeguards, for qualifying goods destined for final consumption or use in Northern Ireland. That was not an exemption from every requirement for every consignment, or a system in which a destination label alone settled everything.[4]
Distinguishing goods more carefully by their destination is not a stirring constitutional slogan. For someone doing the paperwork, it can matter more than one. Some institutional improvements consist in redistributing a burden more closely to the circumstances, rather than discovering a principle that makes every competing concern disappear.
But making rules easier to administer is not the same as giving people a part in changing them. What happens when the EU amends a relevant law? Northern Ireland cannot be treated only as the place where effects arrive, while every route for an objection to travel back remains unspecified.
That question helps explain the attention given to the Stormont Brake. The name suggests a handle: pull it and an unwanted law stops. The actual mechanism is narrower, more conditional, and more revealing than the name.
An objection is not an unlimited veto
At least thirty members of the Northern Ireland Assembly, drawn from at least two parties, can notify the UK government that they want the Brake used. It concerns covered amendments or replacements of EU acts already applying under the arrangements. It is not a general veto over all new EU legislation. New acts have a different route, including applicability motions.[5]
Numbers are not the only conditions. The Executive must be operational and the Assembly in regular session. The change must significantly differ from the existing measure and have a significant, lasting effect specific to everyday life in Northern Ireland. The procedure is a last resort; the members must explain prior engagement and consultation with affected businesses and civil society.[5]
Thirty signatures therefore do not automatically stop a law. The UK government assesses whether the conditions are met and, if satisfied, notifies the EU through the Joint Committee. Blocking the amended version does not automatically abolish the older one. Remove these qualifications and the reader learns about a power that does not exist.
Those conditions may be criticized as too restrictive, or defended as necessary to prevent a common arrangement from being interrupted too easily. Either argument needs to identify who may initiate the process, who decides, and what refusal requires. The 2024 Democratic Scrutiny Regulations specify further procedures, including written reasons where the government rejects the relevant notification.[6]
This is an entrance, not a winning ticket. Its more concrete value is that an objection has an address at which someone is obliged to deal with it. Refusal cannot simply be replaced by silence. Whether the entrance is adequate depends on its thresholds and operation, not merely on the fact that a mechanism has acquired a name.
A separate consent procedure asks whether specified arrangements should continue. On 10 December 2024, the Assembly voted 48 to 36 to continue the provisions in Articles 5–10. The vote secured a simple majority but not cross-community support. Continuation was for four years, and the absence of cross-community support triggered an independent review.[7]
This was not a second referendum on UK membership of the EU. Nor was it a vote on Northern Ireland remaining in the UK or joining a united Ireland. It had a defined object and defined consequences. A majority did not mean everyone agreed; the lack of cross-community support did not make the provisions expire that night.
The UK government commissioned Lord Murphy’s independent review in January 2025. The report appeared in September, followed by the government’s response in December. The sequence did not cancel the vote. It allowed questions about operation, representation and disagreement to continue while the arrangements themselves continued.[8][9]
A government response is not evidence that every recommendation has been implemented. Still less does it show that every business problem has been solved. This essay stops at the end of 2025; it is not a guide to customs procedures in 2026. An official commitment tells us what an institution undertakes to do. Assessing delivery requires subsequent evidence.
None of this tells the reader which side to take on Brexit. It makes a different point available for consideration: exit can end membership without ending the need for shared decisions. Remaining in a working arrangement, in turn, does not entitle its authors to treat an earlier consent as the last word anyone may ever give.
For Northern Ireland, those sentences cannot be completed only between London and Brussels. Legislators, businesses, civil society and disagreeing communities do not all need the same power. Consultation is not a veto, review is not compensation, and a majority vote is not everyone’s signature. Keeping those distinctions visible lets us ask whose route is still inadequate and what kind of answer is still missing.
The lorry still has to cross the sea. The value of an agreement is not exhausted when its authors sign it. Afterwards, a consignment and a person’s objection each need an appropriate route. They are plainly different things. That is precisely why ‘the matter has already been decided’ cannot be enough to close both roads.
