An Apology Is Not a Hearing

The request came five years before the apology. Haiti’s cholera victims sought a hearing, compensation, and prevention. Scientific evidence, institutional acknowledgements, and assistance did not automatically become one route to a remedy.

The request preceded the apology by five years. On 3 November 2011, a petition on behalf of about 5,000 cholera victims was lodged with the UN mission in Haiti. It sought compensation, preventive action, acknowledgement and an apology. It also sought something logically prior to a decision on those demands: a fair hearing.[1]

Sending a request and entering a process that will hear it are different achievements. The petition included both desired outcomes and a procedural demand: somewhere to put losses and reasons for examination. In this case, the distance between those achievements proved formidable.

This essay follows records from 2010 to the new approach presented in 2016. It is not a final account of every later development. The source of an epidemic, institutional responsibility, a court’s jurisdiction, and the remedy owed in a particular claim must also remain distinct. They connect; they are not four names for one finding.

One river, several questions

Cholera broke out in Haiti in October 2010. Field research by French and Haitian investigators linked the distribution and rapid expansion of early cases to the waterways near a peacekeeping camp and downstream. Their 2011 study supplied evidence for introduction through human activity, rather than treating the mere presence of a camp as proof of responsibility.[2]

Not every contemporary institutional account put the matter in the same terms. The secretary-general’s 2011 report relayed an independent panel’s emphasis on interacting circumstances, including contamination and inadequate water and sanitation, while repeating its formulation that did not assign fault to a group or individual.[3]

Epidemiological and genetic research continued. A 2014 scientific review supported the explanation of an imported pathogen spreading through the camp-associated water system. Later evidence cannot be handed to people at the outbreak’s first moment. Nor should early caution permanently freeze what an institution is willing to acknowledge.[4]

The distinction is not between a simple explanation and an evasively complicated one. How a pathogen arrived and how it spread so extensively are connected questions. Poor sanitation can affect transmission without erasing an identifiable introduction. Establishing an introduction does not, by itself, adjudicate every infection, loss, and claim for compensation.

Both shortcuts can remove the affected person from view. Many contributing conditions become a reason to name no actionable conduct; alternatively, identifying a source becomes a reason to stop examining individual harms. A useful account does neither.

The epidemic also cannot be reduced to litigation. Treatment and safe water were urgent. Assistance had real value. But needing clean water now does not take away a person’s standing to ask why the water became unsafe and how a loss should be addressed. Rescue and explanation need not wait for each other. They cannot simply replace each other, either.

The request arrived; the merits did not reach a hearing

In February 2013, the UN’s legal office treated the claims as not receivable, reasoning that their examination would entail review of political and policy matters rather than a dispute of the relevant private-law character. That was the organization’s response. It was not an independent tribunal rejecting damages after hearing the underlying responsibility claim.[1]

The distinction matters. Describing this as an adverse result after a hearing would misstate the obstacle. The claimants were still trying to reach a place where responsibility for their losses could be substantively examined.

Why not go to a national court? The Convention on the Privileges and Immunities of the United Nations provides immunity from legal process unless expressly waived in a particular case. It also provides, in Section 29, for appropriate ways to settle specified private-law disputes. Protection from national proceedings and provision for an alternative remedy belong in the same institutional picture.[5]

There is a serious reason for immunity. An organization working across countries needs protection against national litigation used to obstruct a common mission. Recognizing that concern does not require assuming bad faith whenever immunity is invoked. It also does not answer where someone harmed in connection with the mission is supposed to go.

Some victims did bring proceedings in the United States. In Georges v. United Nations they argued, among other things, that the organization could not retain immunity without providing the relevant alternative dispute settlement. On 18 August 2016, the Second Circuit rejected that condition-precedent argument and upheld dismissal for lack of subject-matter jurisdiction.[6]

That ruling concerned whether the court could hear the case. It was not a judgment clearing the organization on the merits of responsibility for the epidemic. It did not find that the camp had not contaminated the water, or determine the damages payable to each claimant. An inability to reach the merits cannot be retold as a favorable determination of the merits.

The opposite shortcut would be to announce that the court’s treaty interpretation must be wrong because the resulting situation is troubling. Its legal reasoning must be read within its own framework. An essay can examine the institutional gap left afterward without pretending to supply another judicial ruling.

The gap is substantial. A protection designed to keep common work from being obstructed by national proceedings can leave affected people without a corresponding merits forum. Preserving a mission’s independence and addressing harms associated with the mission cannot responsibly remain unrelated tasks.

Where the organization receiving a claim can determine that an entire category is outside its settlement process, a petition and a reply do not establish independent review of that refusal. This identifies a missing route. It does not claim that every form of criticism, investigation, or public questioning has ceased to exist.

Something changed in December

On 1 December 2016, Secretary-General Ban Ki-moon apologized on behalf of the United Nations to the Haitian people. A subsequent official report records the statement and the General Assembly’s acknowledgement of a moral responsibility. It was a significant institutional change, not a damages judgment.[8]

An apology need not be worthless because it is not a judgment. Public acknowledgement can matter to people whose suffering has been described at a distance. Recognizing its importance does not require supplying consequences it did not itself establish.

The new approach proposed two tracks: intensified disease control, treatment, water and sanitation; and material assistance for those most directly affected, their families, and communities. Community and individual approaches were considered, with participation and resources central to the design. This was not a completed determination of an enforceable payment for every claimant.[7]

Community projects have their own value. Better water, sanitation, and support for livelihoods can benefit many people. Dismissing them merely because they are not individual compensation would be another mistake. Yet a new public facility cannot, on its own, answer a particular family’s claim concerning a death. Both can matter; that is why the distinction matters.

A person seeking compensation need not oppose public-health work. Prevention was already among the petitioners’ requests. Someone can want others protected from infection while also asking that a loss not be absorbed entirely into a project directed at the future.

We often judge an institution’s willingness to learn by its willingness to consult experts. This history adds another test. Experts can investigate a source. Staff can design assistance. A secretary-general can apologize. Whether an affected person can initiate substantive examination of a claim remains a further question.

It would therefore be too absolute to say that investigation is no channel, or that assistance is merely camouflage. Investigation may disclose facts; a hearing may test a claim; assistance may help repair a life. The question is how the parts connect, rather than whether one part can stand as proof that the whole route works.

Neither can a proposed programme be reported as completed repair. At this essay’s stopping point, the end of 2016, the new approach was an undertaking to develop and resource. Its later implementation needs later records. The account neither announces success in advance nor treats its own cutoff as evidence that nothing ever changed afterward.[7]

The Rhine companion is useful precisely because its responsibility structure is different. There a common mechanism responded to cross-border consequences of a company’s accident. Here the international operation itself was implicated in introducing harm. It could not answer only as a helper managing a disaster that had happened elsewhere. Claims about its own conduct were part of the question.

That is also why the two essays should not become a league table of successful and failed cooperation. Environmental improvement can coexist with individual questions requiring another forum. A serious remedial gap can coexist with valuable assistance by people working inside the institution. Neither fact cancels the other.

The original request placed hearing, compensation, prevention, and apology side by side. Different developments answered different parts. No single word should be allowed to speak on behalf of all the rest.

An apology can begin something new. Whether it also opens a door for the person who made the request is a question to take back to that door.
