The Trial in a World Without a Court

Edition note: An independent English essay on The Will to Battle. Full-book spoilers.

The murder conspiracy is known, and the world wants a trial. The trouble is not only evidence. The acts crossed Hives, homes, jurisdictions, and spaces deliberately kept outside ordinary law.

Ockham answers with terra ignota: unknown land, a place where no established sovereign can simply announce that its rules already apply.

Peaceful law discovers the crime it was not designed to see

The Hive system lets citizens choose political membership and permits different institutions to coexist. It worked partly by avoiding a single court with authority over everyone.

The conspiracy used that pluralism as cover. Leaders acted through private relationships and cross-Hive arrangements, then relied on gaps between jurisdictions when responsibility arrived.

Government authorization cannot solve the problem. An official may order an act and still lack the right to make it lawful; an executor may obey and still owe an account of what was done.

An unknown legal space is a question, not an exemption

New circumstances do require new rules. Applying a familiar criminal code without considering jurisdiction, secrecy, and systemic complicity might produce a convenient verdict rather than a just one.

But “no prior court can judge me” cannot mean “nobody may judge me.” That would give the greatest freedom precisely to people powerful enough to create unprecedented conditions.

A legitimate process must be built publicly: representatives of affected Hives, victims' evidence, independent judges, disclosed conflicts, and a rule narrow enough that it cannot later become a general license for global punishment.

The will to war appears before armies move

While the legal order hesitates, factions begin choosing symbols, uniforms, stories, and enemies. Each preparation is described as protection against what the other side may do.

Preparing can deter attack, but it also teaches people to read every ambiguous act through the coming conflict. A shipment becomes mobilization; criticism becomes disloyalty; compromise looks like surrender.

The trial matters because a society unable to judge public wrong without dividing into camps will ask war to deliver the verdict. The first shot has not yet been fired, yet peace is already failing when nobody trusts a shared process enough to remain inside it.
