Edition note: An independent English rewriting for viewers of Hwang Dong-hyuk’s 2011 film Silenced. It preserves the Chinese argument while reorganizing its sequence for an English-language essay. Full-film spoilers.
The courtroom in Silenced is disturbing because it does not abandon procedure. Lawyers argue, witnesses are tested, settlements are signed, and judges pronounce reasons. The film asks what happens when every local step can be defended while the path as a whole reproduces the power with which the case began.
The defense retains a lawyer who recently served as a judge in the same local legal world. South Korea has a term for the advantages often associated with such former officeholders: jeongwan yeu, preferential treatment rooted in professional relationships. The film does not need a judge to announce favoritism. Its point is precisely that informal deference can affect a case without appearing in the written judgment.
The defense need not prove that nothing happened. It can place a question mark beside every route by which the children’s accounts arrive: sign-language interpretation may be imperfect; human-rights workers may have influenced recollection; In-ho has a dispute with the school; Yoo-jin is an activist who needs a case.
Each premise contains something true. Translation is mediated. Preparation can shape testimony. Advocates and whistleblowers have histories. But “not perfectly unmediated” is not the same as “unworthy of belief.” The defense compresses that distance until the children’s dependence on interpretation becomes a reason to exclude what they say.
Some families accept money and withdraw. The easy response is moral condemnation. The harder response is to compare what each side can endure. The institution has lawyers, relationships, and time. Families already burdened by poverty and disability face travel, public exposure, lost work, and an uncertain trial. An offer need not be accompanied by a threat when exhaustion is doing the coercive work.
A rule designed to respect a complainant’s wishes can therefore become a price schedule for the accused. Formal consent remains; the distribution of practical alternatives does not become equal.
The film’s argument accumulates: retain the well-connected former judge; challenge the route of interpretation; recast support workers as suggestive outsiders; convert family precarity into settlement; sentence under the law then in force. None of these acts alone explains the outcome. Their sequence does.
That sequence also complicates blame. Defense counsel is expected to test evidence. Judges must use existing law. Parents may reasonably choose a certain payment over a ruinous contest. Parishioners may sincerely trust the public identity they know. Ordinary role morality can still aggregate into injustice.
The answer is not that law should dispense with cross-examination or settlements. Those protections exist for good reasons. The film’s warning is narrower and more demanding: a safeguard cannot interpret its own use. Human judgment must ask who benefits from a doubt, who can afford delay, and whether a protection for vulnerable people has been converted into protection from them.
A chain of proper steps is not self-validating. Procedure earns legitimacy only when we remain willing to inspect the destination it repeatedly produces.

一间法庭。
原告席上坐着几个孩子和他们的家人。被告席上坐着几个人。
旁听席坐满了人,大部分是来支持被告的。
案子开庭之前,学校方面做了一件事:他们请了一位律师。
这位律师不久前还是法官,就在这个地方的法院。
这在韩国有一个说法,叫"前官礼遇"。
意思是:一个刚从法官或检察官位置上退下来的人,去当律师,他经手的案子会得到一些照顾。因为对面坐着的还是他从前的同事、下属、学生。
这不违法。
没有一条法律禁止退休法官当律师。没有一条法律禁止法官审理由前同事代理的案件。
它是一个成例。所有人都知道,所有人都默认,而它写不进任何一份判决书。
开庭之后,主审法官换了人。
这一步也是合规的。
这是这一篇的核心,而它需要被说得很准确。
辩方律师没有试图证明那些事没有发生。
他做的是另一件事:让人不相信说这些事的人。
具体的办法有三条:
第一条:这些孩子是聋人。
他们的证词必须经过手语翻译。辩方指出:翻译可能不准确,孩子的表达可能有歧义,同一个手势可以有不同的理解。
这个说法在技术上不是完全没有道理。
而它的效果是:这些孩子说的每一句话,都被加上了一个问号。
第二条:这些孩子接触过人权组织。
辩方指出:孩子在作证之前,和人权中心的工作人员接触过很长时间。那么,他们说的是自己记得的,还是被引导的?
这个说法在技术上也不是完全没有道理。
而它的效果是:孩子的证词被说成了一份可能被加工过的东西。
第三条:告发者有个人动机。
姜仁浩是花钱进来的,他和校方有过冲突。辩方指出:他可能是在报复。
徐幼真是人权活动家。辩方指出:她需要案子来证明自己的价值。
这三条加起来,构成了一个完整的说法:一群表达能力受限的孩子,被两个有动机的成年人引导,说出了一套指控。
必须把这一点说清楚,因为它是这部电影最锋利的地方。
辩方律师没有伪造任何东西。
他没有制造假证据。他没有收买证人。他没有威胁任何人。
他指出的那些问题,全部是真实存在的:手语翻译确实可能有误差;孩子确实和人权组织接触过;告发者确实和校方有过冲突。
每一条都是真的。
而它们被组合起来的效果,是让一群受害的孩子变成了不可靠的证人。
这里有一道很宽的缝:
"可能不准确"和"不可信",是两件事。
而在一间法庭里,这两件事之间的距离会被压缩成零。
案子进行到一半的时候,发生了这件事。
一部分家长收了钱,撤了诉。
这一段是这部电影最容易被写错的地方。
因为骂这些家长是最容易的。
先看清楚他们面对的是什么。
一边是一笔钱。对他们中的一些人来说,那是一辈子攒不出来的数目。
另一边是一场看不到头的官司。 要请律师,要请假,要跑法院,要面对整个城市的目光——而对面的人有钱、有关系、有一个刚退下来的法官当律师。
还有一层更重的:这些家庭本来就是最没有余地的那一批。
孩子被送到这所寄宿学校,本身就说明家里照顾不了。 有的家里老人带着,有的父母在外地打工,有的家庭已经因为孩子的残障背了很多年的债。
那套体系精确地知道该往哪里施压。
它不需要威胁任何人。它只需要提出一个数字,然后等着。
和解之所以能起作用,是因为当时的法律里有一类规定:某些案件,如果受害方与被告达成和解并撤回控告,追诉会受到影响。
这条规定的初衷不难理解。
它是为了保护受害人的意愿——有些案件,受害人不愿意让事情被公开审理,法律应该尊重这个选择。
它本来是一条保护性的规定。
而在这个案子里,它被这样用了:
它成了被告方的一个价目表。
只要出得起价,就可以让一部分指控消失。
这就是这部电影最需要被记住的一处:
一条为了保护受害人而设的规定,被用来保护了加害者。
而这个过程中,没有任何人违法。
判决下来了。
有罪,但是刑期很短,而且是缓刑。
被告当庭释放。
旁听席上有人鼓掌。
孩子们坐在原告席上,看着那些人走出去。他们听不见掌声。而他们能看见那些人在笑。
现在把这个判决是怎么来的,从头看一遍:
第一步:被告方请了一位刚从这个法院退下来的法官当律师。合规。
第二步:主审法官更换。合规。
第三步:辩方指出手语翻译可能有误差。属实。
第四步:辩方指出孩子接触过人权组织。属实。
第五步:辩方指出告发者与校方有冲突。属实。
第六步:一部分家长接受和解,撤回控告。合法。
第七步:依据当时的法律,判处缓刑。依法。
每一步都合规。
七步走完,判决出来了。
这就是这部电影真正在问的问题,而它不是"谁是坏人"。
它问的是:一套每一步都合规的程序,怎么会走到这里。
如果这件事的原因是几个坏人,那么答案很简单:把他们抓起来。
而这条链子上,有一半的环节不是坏人干的。
那位律师做的是他的本职工作——为当事人辩护,指出对方证据中的疑点。
那位法官依据的是当时有效的法律。
那些收钱的家长,面对的是一笔他们攒不出来的钱和一场打不完的官司。
旁听席上鼓掌的人,很多是真的相信校长是无辜的——因为他们认识的那个校长,是教会里那个做慈善的长老。
每一个人都在做一件在他自己的位置上说得通的事。
而这些事加起来,把一群孩子挡在了外面。
